AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (t988) BY AMENDING SECTIONS 22-245(b), 22; <br />267, AND 22-268, BY REPEALING SECTIONS 22-266 AND 22-269, AND BY <br />ADOPTING NEW SECTIONS 22-266.1, 22-266.2, 22-268.1, 22-271, 22-271.1, 22- <br />271.2, 22-271.3, AND 22-271.4 PERTAINING TO OVERWEIGHT MOTOR <br />VEHICLES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 22-245(b), 22-267, and 22-268 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 22-245. Weight of vehicles and loads. <br /> <br /> (b) The provisions of this section shall not apply to a vehicle designed for <br />towing disabled vehicles, when towing such vehicle in an emergency in such manner that <br />a part of the combined weigh; of the two vehicles or size of the two vehicles rests upon <br />an axle or axles of the towing vehicle: provided, that the towed and towing vehicle each <br />are within the weight limits prescribed in the above-referenced sections of the Code of <br />Virginia. The provisions of this paragraph shall not be construed to permit the violation <br />of any lawfully established limit on any bridge. For the purposes of this section, <br />"emergency" includes towing disabled inoperative vehicles to places designated by <br />owners. <br /> <br />Sec. 22-267. Vehicles hauling cargo in seagoing containers. <br /> <br /> (a) A special permit to operate or move a vehicle of a weight exceeding the <br />maximum specified in this article on the streets or highways of the city shall be granted <br />without cost where the vehicle is hauling containerized cargo in a sealed seagoing <br />container bound to or from a seaport and has been or will be transported by marine <br />shipment. In order to qualify for such a penmt, the contents of such seagoing container <br />shall not be changed from the time it is loaded by the consignor or his agents to the time <br />it is delivered to the consignee or his agents. <br /> <br />Sec. 22-268. Concrete mixers. <br /> <br /> (a) The city manager or his designee, upon application in writing made by the <br />owner or operator, shall issue overweight permits for operation of certain vehicles used m <br />haul concrete. Permits under this section shall be issued only for vehicles that are used <br />exclusively for the mixing of concrete in transit or at a project site or for transporting <br />necessary components in a compartmentalized vehicle to produce concrete immediately <br />upon arrival at the project site, and either have (i) four axles with more than 22 feet <br />between the first and last axle of the vehicle or (ii) three axles. Any vehicle operating <br />under a permit issued pursuant to this section shall have a gross weight not exceeding <br /> <br /> <br />
