actions are to be performed within the limits of the project, the contractor performing the <br />work shall obtain a permit from the City Engineer at no cost to the contractor. Provided <br />further, no such permit shall be required of any person to dig up, break, excavate, tunnel, <br />undermine, or in any manner disturb the surfaced or subsurface of any street, lane, alley <br />or public right-of-way which has not been duly accepted by the city as a public right-of- <br />way. <br /> <br />Sec. 32-59. Application for permit; applicant's bond. <br /> <br /> (c) The applicant shall sign the application and accompany the same with a bond <br />in a form and of a type approved by the city attorney in the penal amount provided below <br />payable to the city and conditioned upon the applicant's compliance with this article and <br />the conditions and agreements of his application and conditioned to save harmless the <br />city from any loss or damage by reason of any injury to any person or property <br />occasioned by the negligence of the applicant, his servants, agents, employees, <br />subcontractors or any independent contractors hired by him or occasioned by the failure <br />of the same to comply with this article or the conditions and agreements of the <br />application. The bond shall contain a further provision that, upon demand by the city, the <br />applicant shall be required to defend, pay the cost of defense, furnish attorney or <br />attorneys for the defense of, any claim made against the city which may be based upon <br />any injury to any person or property occasioned by the negligence of the applicant, his <br />servants, agents, employees, subcontractors or any independent contractors hired by <br />applicant or occasioned by the failure of the same to comply with this article or the <br />conditions and agreements of the application. <br /> <br /> The amount of the bond shall equal the stated value of the work; except that a <br />corporation covered by the provisions of (b) shall annually on or before the first working <br />day in January post a bond in the amount of $100,000 which shall cover any work <br />performed by the contractor during the year. <br /> <br />Sec. 32-60. Issuance of permit; revocation. <br /> <br /> (a) The city engineer upon receipt of application in proper form, of a proper <br />bond, and of satisfactory written evidence of adequate and effective insurance coverage, <br />or self-insurance, shall determine the charges to be paid by the applicant to the city in <br />accordance with the charges set forth in section 32-61 and inform the applicant of 'same. <br />If, in the opinion of the city engineer, the proposed work is a necessary and proper use of <br />the city's streets or rights-of-way and all proper and reasonable requirements to assure <br />future maintenance are satisfied, he shall issue a penmt for same. <br /> <br />Sec. 32-61. Schedule of fees and charges. <br /> <br /> (a) Non Residential Construction. An.inspection fee of $40.00 shall be <br />charged for land disturbance in the right of way, not exceeding 100 square feet. A fee of <br />$40.00 plus $1.00 per square foot disturbed shall be charged for such land disturbance in <br /> <br /> <br />
