AN ORDINANCE TO AMEND CHAPTER 32 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 32-6, 32-58(a) <br />AND (b), 32-59(c), 32.60(a), 32-61, AND 32-71 THEREOF AND BY REPEALING <br />SECTION 32~7 THEREOF PERTAINING TO CONSTRUCTION IN THE <br />PUBLIC RIGHT OF WAY. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 32-6, 32-58(a) and (b), 32-59(c), 32-60(a), 32-61, and 32-71 <br />of the Code of the City of Portsmouth, Virginia, be amended and reordained to read as <br />follows: <br /> <br />Sec. 32-6. Lowering curbs; laying private driveways or ramps. <br /> <br /> (a) No person shall lower or cut the curb on any street, or lay any private <br />driveway or ramp crossing any sidewalk of the city without first obtaining a permit <br />therefor from the city engineer. All such driveways or ramps shall be constructed and <br />curbs lowered according to plans to be furnished by the city engineer. The city engineer <br />shall inspect all such work, which shall be subject to such conditions as he may prescribe <br />as to materials used and manner of construction. All such driveways or ramps shall be <br />fully paved over their entire width between the edge of the pavement of the street and the <br />property line of the property to be served by such driveway or ramp. All paving and <br />repaving, where necessary, shall be done at the expense of the person receiving such <br />permit. It shall be the duty of the owner of such driveway at all times to keep the <br />sidewalk crossed by such driveway or ramp in good repair at his own expense. Permit <br />fees for driveways shall be $30.00 per driveway apron for single-family property, $60.00 <br />per apron for duplexes, and $200 per driveway apron for all other property. <br /> <br /> (b) Unless othenvise exempted by the city code, all new construction shall <br />have at least one driveway apron that meets all city code requirements. <br /> <br />Sec. 32-58. Permit required; exceptions. <br /> <br /> (a) It shall be unlawful for any person to dig up, break, excavate, tunnel, <br />undermine, or in any manner disturb the surface or subsurface of any street, lane, alley or <br />public right-of-way in the city without first having obtained from the city engineer a <br />permit to do so, except as otherwise provided for herein; nor shall such work be <br />performed after such permit shall have been revoked or shall have become ineffective. <br />All work shall be performed in accordance with the City of Portsmouth Standards and the <br />City of Portsmouth "Engineering Standards for Work in the Right of Way." <br /> <br /> (b) If any person is required to dig up, break, excavate, tunnel, undermine, or <br />in any manner disturb the surface or subsurface of any street, lane, alley or public right- <br />of-way, and if such actions are required by the city through its repair, alteration, or <br />widening of any such street, lane, alley or public right-of-way or any sidewalk and if such <br /> <br /> <br />
