AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADOPTING A NEW SECTION 24-21 <br />PERTAINING TO COURT COSTS AND CRIMINAL PROCESSING FEES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Chapter 24 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by adopting a new Section 24-21 to read as follows: <br /> <br />Sec. 24-21. Convictions; additional court cost; processing fee. <br /> <br /> (a) Every person convicted of a violation of any state statute or city ordinance <br />shall be assessed the sum of $5.00 as part of the costs in each criminal case in the district <br />and circuit courts in addition to any other established court costs. The assessment shall <br />be collected by the clerk of the court in which the case is heard, remitted to the city <br />treasurer, and held by the city treasurer subject to appropriation to the sheriff for the <br />funding of courthouse security personnel. <br /> <br /> (b) The provisions of subsection (a) shall expire on July 1, 2004. <br /> <br /> (c) A processing fee of $25.00 is authorized against any individual admitted <br />to the city jail following a conviction of any violation. Pursuant to section 15.2-1613.1 of <br />the Code of Virginia, the clerk of the court in which the case is heard shall collect the fee <br />and deposit it into the account of the city treasurer for use by the sheriff's office to defray <br />the costs of processing arrested persons into local jails. <br /> <br /> 2. That the provisions of this ordinance shall take effect on the date of its <br />adoption. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on July 9, 2002. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
