kN ORDt~%~NCE I~POEING A~D LEVYING A TAX, FOR THE PERIOD BEGiN~NING AUGUST 1, 1958, AND THEREAFTER, ON THE RECORDATION iN' TI~E CITY OF PORTS~OU]=6 OF EACH INSTRU~ENT SLrBJECT TO TEE STATE RECOP~DATION TAX I~POMED BY ARTICLE 3 OF CHAPTER 3 OF TITLE 58 OF TME CODE OF VIRGINIA 1950-, WI/~q CERTAIN ~CEPTIONS, PRESCRIBING ~ RATE O.w AND PROVI;)[NG FOR I~_~iE COLLECTION OF SAID CITY RECORDATION TAX. WHEREAS, by Chapter 590 of the Acts of the General Assembly of Virginia of 1958, approved ~arch 29, 1955, effective June 27, 1958, the Code of Virginia, 1950, was amended by adding thereto a section numbered 58-65.1, authorizing cities and counties to impose a city or county recordation tax in addition to the State recordation tax; and ~qE;..S, it is necessary for the operation of the various Departments of the City that provision be made to impose and levy a city recordation tax and to provive for the collection thereof, as hereinafter set forth, for the purpose of providing funds for municipal purposes; now, therefore, BE IT ORDAINED by the Council of the City of Portsmouth: Section 1:- For the period beginning August 1, 1958, and thereafter there is hereby imposed and levied by the City of Portsmouth, pursuant to the provisions of Article 3 of Chapter 3 of Title 58 of the Code of Virginia, 1950, a tax on the recordation in the City of Portsmouth, of each instrument subject to the State recordation tax imposed by sai~ Article 3, except any instrument on which the State recordation tax is fifty cents specificall~, in an amount equal to one-third of the amoun~ of the State recordation tax collectible for the State on the first recordation of each taxable instrualent in the City of Portsmouth, pursuant to the provisions of said Article 3~ provided, however, that where a deed or other instrument conveys, covers or relates to property located in the City of Portsmouth and also to property located in a county or another city, or in counties or other cities, the tax hereby imposed and levied shall be computed only with respect to the property located in the City of Portsmouth. Section 2:- The Clerk of the Court of Hustings for the City of Portsmouth shall collect the ~ax hereby imposed and levied and, on or before the tenth day of each calendar month, shall remit such taxes collected during the preceding calendar month to the City Collector of the City of Portsmouth, Adopted ~ the Council of the City of Portsmouth, at a meeting held July Sth, 1958.
