ORDINANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY IN NANSE- <br />~O~D CObS~TY~ VIRGINL~ NECESSARY FOR USE BY THE CITY FOR WATERWORKS AND <br />RELAT~ FACILITIES, PURSUANT TO C~PTER 258 OF THE ACTS OF ASSEMBLY OF 1958o <br /> <br /> W}{EREAS, the City of Portsmouth has found it to be necessary to enlarge its <br />water~'orks system to meet the demands of the area served by it and is in the pro- <br />cess of constructing certain additional dams and reservoirs to provide much needed <br />raw water storage; and <br /> <br /> Wt{EREAS, the City of Portsmouth has not been able to purchase certain property <br />necessary to this project after lengthy negotiations and advancement of the work will <br />be delayed unreasonably if the said property is not made available as soon as possible; <br /> <br /> NOW THEP~EFORE, Be it ordained by the Council of the City of Portsmouth, Virginia, <br />that the City Attorney is directed ~o institute eminen~ domain proceedings against the <br />parcel of property hereinafter described, in accordance with and pursuant to Section <br />23-f of the Charter of the City of Portsmouth (chapter ~58 of the Acts of Assembly <br />of I955), and that the sum hereinafter specified with respect to said parcel be de- <br />posited to the credit of the court as provided by law: <br /> <br /> The land to be acquired in fee simple, its owner, the approximate area thereof, <br />and the amoun~ to be paid into court are as follows~ <br /> <br /> That certain parcel of land situate in Nansemond County~ Virginia, more par- <br />ticularly described as follows: <br /> <br />Beginning on the mean low tide line of Cohoon Creek at a point of <br />intersection with the center line of a cove separating the hereby <br />described land from the land of Ro Ao Harry; thence, across the <br />marsh ~ 74© 10' W - 414' to s point at the head of same cove, thence~ <br />S 8o 0~' E - 384' to ~ point on a road; thence, S 15© 00' E - 208' <br />to a point in a cove; thence, S ~?o 0~' E - 1E9' to a point in the <br />cove, thence, S 88° 15' E - 4~2' to the point of intersection of the <br />cove with the center line of Smith Creek: thence, along the western <br />edge of Smith Creek in a northern direction to the southern edge of <br />Cohoon Creek; thence, along the southern edge of Cohoon Creek in a <br />western direction to the point of beginning: The hereinabove described <br />tract is bounded on the North by Cohoon Creek. East by Smith Creek and <br />South and West by the land of Ro A, Harry. <br /> <br />For a more exact description, reference is hereby made to plgt entitled <br />'~Water Departmen%, City of Portsmouth, Virginia, Proposed Reservoir <br />Cohoon Creek Area,, Nansemond County, Virginia," dated February 15, lS55~ <br />prepared by R~ Kenneth Weeks, Engineers, Norfolk, Virginia° <br /> <br /> The owner of this parcel is Emm~ Louise Dodd~ th~ approximate area thereof is <br />12o55 acres, and the amount to be deposited is $35~000.00. <br /> <br /> This is to certify that the foregoing is a true and correct copy of an ordi- <br />nanc~-a~opted on second reading by the Portsmouth City Council at a meeting held <br />June 2, 1959o <br /> <br />City Clerk <br /> <br /> <br />
