AN ORDINANCE TO AMEND THE BUILDING CODE OF THE CITY OF PORTSMOUTH, 1948, kS kMENDED, BY ADDING TO CHAPTER I THEREOF A NEW SECTION TO BE NU%~ERED SECTION ll5, PRO- VIDING ADDITIONAL REGULATIONS WITH RESPECT TO BUILDING PERMITS FOR FALL-OUT AND BO;~B SHELTERS. WHEREAS, the Council of the City of Portsmouth is cognlzan~ of the emphaszs now being placed upon construction of fall-out and bomb shelters; and WHEREAS, the Council of the City of Portsmouth is desirous of assur- ing persons who construct such shelters that they are efficient and that full value is received by the owner for the expense o£ such construction; and WHEREAS, the Council of the City of Portsmouth is desirous of pro- tecting adjacent property owners from any possible harmful effect of such shelters by affirming the applicability of the zoning and other regulations with respect to buildings situate within the City. NfY~', THEREFORE, BE IT ORDAINED by the Council of thc City of Ports- mouth, Virginia, that the Building Code of the City of Portsmouth, 1948, as amended, be amended by adding to Chapter I thereof a new section to be numbered Section 115, to read as follows: SECTION 115 - FALL-OUT AND Bf~IB SHELTERS 115.1 - APPLICATION OF CODE AND OTHER REGULATIONS Fall-out and bomb shelters are buildings within the ~erms of this code, as well as all other codes, ordinances and regulations concerning the Construction, maintenance and use of buildings, whether or not such shelters are a part of another building and whether or not they are above or below ground. 115.2 - SPECIAL PROVISIONS GOVERNING ISSUANCE OF BUILDING PERMITS The following procedures shall be followed by the Building Official and other interested persons whenever a building, or any part thereof, is con- structed or remodled for use as a fall-ouT or bomb shelter: (a) The Building Official shall not be required to issue the build- ing permit for any such consmruction until the expiration of ten days from the
