AN ORDINANCE TO A~END THE ORDINANCE ADOPTED JUNE 27, 1961,
<br />ENTITLED "AN ORDINANCE IMPOSING SERVICE CHARGES, FOR THE
<br />PERIOD BEGLNNING JULY I, 1961, AND THEREAFTER, ON THE COL'
<br />LECTION AND DISPOSAL OF GARBAGE AND REFUSE FROM BUSINESS
<br />AND INDUSTRIAL ESTABLIStt}FENTS, FOR EMPTYING DUMPSTER-TYPE
<br />CONTAINERS, FOR SPECIAL TRIPS, FOR HANDLING REFUSE AT CITY
<br />INCINERATORS, DUMPS AND LAND FILLS, PROVIDING BILLING AND
<br />COLLECTION PROCEDURES AND IMPOSING AN ADDITICC{AL CHARGE
<br />FOR LATE PAYMENT," BY ADDING THERETO A NE5¥ SECTION NUMBERED
<br />SECTION 8.1, FURTHER DEFINING THE TER~S "PERSON, FIRM,
<br />CORPORATION OR ASSOCIATION" AND "PERSON" CONTAINED IN SEC-
<br />TIONS 5, 6, 7, AND 8 OF SAID ORDINANCE, AND DECLARING THE
<br />INTENT OF THE COUNCIL WITH RESPECT THERETO.

<br /> WT~EREAS, Sections 5, 6, 7, and 8 of the ordinance adopted June 27,
<br />196!, entitled "An Ordinance Imposing Service Chargesj for the Period Be-
<br />ginning July 1, 1961, and Thereafter, on the Collection and Disposal of Gar-
<br />bage and Refuse from Business and Industrial Establishments, for Emptying
<br />Dtnnpster-type Containers, for Special Trips, for Handling Refuse au City
<br />Incinerators, Dumps and Land Fills, Providing Billing and Collection Proce-
<br />dures and Imposing an Additional Charge for Late Payment" contains the terms
<br />"person, firm, corporation or association" and "person"; and
<br />
<br /> WHEREAS, the intent of the Council in adopting the said ordinance
<br />was~that the charges imposed by Sections 5, 6 7, and 8 thereof be imposed
<br />against any entity whatsoever using the services and facilities therein de-
<br />scribed including specifically, but without limitation, Portsmouth Redevelop-
<br />men~ and Housing Authority; and
<br />
<br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has declined
<br />To pay the charges unless the ordinance specifically describes it as being sub-
<br />ject thereto.

<br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
<br />Portsmouth:
<br />
<br /> Section I: that the ordinance adopted June 27, 1961~ entitled "An
<br />Ord'inance Imposing Service Charges, for the Period Beginning July l, 1961, and
<br />Thereafter, on the Collection and Disposal of Garbage and Refuse from Business
<br />and Industrial Establishments, for Emptying Dumpster-type Containers, for
<br />Special TTips, for Handling Refuse at City Incinerators, Dumps and Land Fills,
<br />Providing Billing and Collection Procedures and Imposing an Additional Charge
<br />for Late Payment," be amended by adding thereto a new section numbered Section 8.1,
<br />
