so to do; provided, however, that the city may authorize operations of <br />employee haulers as de£ined in Section l$-Sg of this code without forfeiture <br />of the payments required hereunder° <br /> <br />Section 16-23. Indemnification o£ city. <br /> <br /> Any company or individual operating under the provisions of this <br />article shall by acceptance in writing of the terms and conditions of this <br />article agree and bind itself to keep and hold the city free and harmless <br />from liability for any and all damages that may accrue to itself or to any <br />person on account of injury to or death of persons or damage to property direct- <br />ly or indirectly growing out of the construction of its works or out of the <br />operation of its vehicles under ~his article, wherever the city is liable <br />therefrom; and in case suit shall be brought against the city, either inde- <br />pendently or jointly with the company or individual on accoun~ thereof, the <br />company or individual, upon notice to it by the city, shall defend the city <br />in such suit, and in the event of a judgment being obtained against the city, <br />either independently or jointly with the company or individual on account of <br />the acts or omissions of the company or individual, the company or indivi- <br />dual will pay the judgment, with all costs, and hold the city harmless there- <br />from; provided, however, this section shall not be operative as to any such <br />act or omission which is covered by any.personal injury liability and pro- <br />perty damage insurance policy maintained pursuant to Section 16-36 of this <br />article. <br /> <br />Section 16-36. Permit; bond; insurance. <br /> <br /> Before any company or individual shall operate any motor buses on <br />the routes herein provided, said company or individual shall file with the <br />city manager an application for a permit so to do, together with a written <br />agreement, in form approved by the city attorney, that it will conform to <br />and comply with all the provisions of this article. No permits shall be <br />granted to a company or individual to operate under this article unless the <br />applicant shall undertake to operate on all of said routes. <br /> <br /> Upon receipt of such application and agreement, the city manager <br />shall issue a certi£icate, in form approved by the city a~torney, authorizing <br />the applicant ~o operate buses as provided in this article upon the filing <br />of a bond with Surety approved by the city attorney, in the sum of twenty <br />thousand dollars, couditioned that the applicant will conform to and comply <br />with each and every condition and provision of this article, and will indemnify <br />and save harmless the city or any person from any and all claims, demands or <br />judgments on account of death, injurles or damages occasioned by the negligence <br />of such applicant subject to the limitation contained in Section 16-23 hereof; <br /> <br />-4- <br /> <br /> <br />
