calendar month, and all of such payments shall be accompanied by a statement <br />of the amount of such gross revenue, sworn to by the treasurer, assistant <br />treasurer, secretary or assistant secretary of the company or by such indivi- <br />dual. All of the payments to be made under this section shall be a lien upon <br />all of the vehicles and property of the company or individual, prior and <br />superior to any other lien or encumbrances thereon, and may be collected by <br />the city by levy, distress or by civil action. Should any such company or <br />individual fail to make any payment above-mentioned within thirty days after <br />the same shall become due and payable, the company or individual shall, in <br />addition to the remedies above-mentioned, be and become liable to a fine of <br />not less than five dollars nor more than one hundred dollars, each day's failure <br />to be a separate offense. Should any such company or individual continue for <br />thirty days in default as to any such payment, the city council may require and <br />order such company or individual to cease running or operating its vehicles <br />upc~ the city streets, or any part thereof. Should any such company or indivi- <br />dual, after notice of any such requirement by the city, and while so continu- <br />ing in default, run or operate any of its vehicles on the streets of the city, <br />in addition to any other penalties prescribed by law, it shall be liable to a <br />fine of not less than five dollars nor more than one hundred dollars for each <br />and every vehicle so operated and each day's operation of any such vehicle shall <br />be a separate offense. <br /> <br /> The payment of such sums for the use of the streets shall be in lieu <br />of any and all city license taxes. But it is expressly stipulated that such <br />payment shall not affect the liability of any such company or individual to <br />general taxation at the rate assessed on the property of other persons within <br />the city, which liability for general taxation is hereby expressly recognized <br />and shall continue during the whole period for which this ordinance remains in <br />force. <br /> <br /> During the continuance of the operation of buses under this article, <br />should the city, without the consen~ of any company or individual operating <br />hereunder, issue license for or authorize the operation of any other motor <br />buses or other motor vehicles in like service; except taxicabs and cars knoWn <br />as'~or-hire cars" not operating on prescribed schedules and rou~es, for the <br />transportation of passengers for hire, except as provided for under the terms <br />and conditions of this article, then the said company or individual upon written <br />notice to the city of its objection thereto shall have the r~ght ~o cease paying <br />the one and one-half (1½) per cent of the gross revenue as provided for in <br />this article during such time as such other motor vehicles in like service are <br />licensed or are authorized and are operated thereunder, and the company or indi- <br />vidual operating hereunder shall have the right to discontinue the whole opera- <br />tion conducted by it after giving to the city six months' notice of its purpose <br /> <br />-3- <br /> <br /> <br />
