~N ORDINANCE TO PROVIDE FOR TiIE ACQUISITION OF CERTAIN PROPERTY BY TiIE CITY OP PORTSMOUTH UNDER ENiINENT DO>~AiN PROCEEDINGS PURSDANT TO CttAP'PER 258 OF THE ACTS OF ASSEMBLY OF i958~ SAID PkOPEPJiES BEING NECESSAP, Y FOR i~,IPROVEMENT OF Tile CITY'S KATERWORKS. gHEREAS, the City of Portsmouth ~ns found it ~o be necessary to improve its waterworks by providizg additiona! water storage facilities at the five mile pumping station: ~nd WHEREAS, the City of Portsmouth has not been able to purchase certain property necessary to this project because the title thereto is subject to objection for reasons of law sad survey; and W!!EREAS, advancement of the work wilt be delayed unreasonably if the said property is net made available as soon as possibie. NOW~ NiEREFORE~ be it ordained by the Council of the City of Portsmouth~ Virginia, that the City Attorney is directed to institute eminent domain proceedings against the property hereinafter described in accordance with and pursuant to Section 23-f of the Charter of the City of Portsmouth (Chapter 2S8 of the Acts of Assembly of i958)~ and tha~ the sum of $I~000~00 be daFosited to the credit of the court as provided by la~ to compensate the owners thereof: (a) The owners of record are as follows: Doris Morrison and the heirs, devisee% and lien creditors of Luke Riddick~ (b) The interest to be acquired is the fee si:spic estate in and to the property hereinafter described, (c) The approximate area is two (2) scres~ (d) The description of the property is as follows: That certain oarcel of land s~tuate in the City of Portsmouth~ Virginia, more particularly described as follows: Beginning at the point where the southern right of way line of Seaboard Air Line Railroad Company is intersected by ~he eastern line of Ponderosa Street (formerly Lincoln Street) and running thence along Ponderose Street 420 feet ~o a point; thence in an easterly direction along the property tine of Rufus W. and Pinkie L, Thompson 210 feet to a polar; thence in a northerly direction parallel to Ponderosa Street along the property line of the City of Portsmouth 420 feet to a point; thence in a westerly direction along the right of way line of Seaboard Air Line Railroad Company 210 feet to the point of beginning; being all of the property conveyed to Doris Morrison by deed recorded in Deed Book 1013~ page 224, Norfolk County Circuit Court~ and to Luke Riddick by deed recorded in Deed Book 99~ page 125~ Norfolk County Circuit Court. ln~s ordinance being necessary for the preservation of the public health~ morals and safety, an emergency is declared to exist~ and it shall take effect from !ts passage, Adopted by the Counczi of the City of Portsmouth~ Virginia, at a meeting held June 12, 1962~ Ci%¥ Clerk.
