AN ORDINANCE TO VACATE A PLANTING <br />EASEMENT SHO~¥N ON THE PLAT OF <br />COLLINSWOOD, SECTION 1. <br /> <br /> ~MEREAS, by subdivision plat recorded in <br />· ~ap Book 3, at page 94~ in the Clerk's Office ., <br /> of the Court of Hustings for the City of Portsmouth,~ ~i ':'~. <br /> there was dedicated to the City of Portsmouth a <br /> )lanting easement on lamd adjoining the rear of Lots <br /> ~:1 through 13, both inclusive; and <br /> <br /> ~HEREAS, the planting screen intended for <br />said area has been placed upon the rear of the <br /> ;aid lots and dedication of the said planting <br /> asement to the City of Portsmouth was not required <br />by the Subdivision Regulations of the City of Ports- <br />mouth, nor recommended by the Planning Commission; and, <br /> <br /> WII£REAS, development of the area affected by <br /> said planting easement is hampered by its existence. <br /> <br /> NOW, THEREFORE, Be it ordained by the Council <br />of the City of Portsmouth, Virginia, that the <br />planting easement adjoining the rear of Lots 1 <br />through 13, both inclusive, as shown on the plat of <br />Collinswood, Section i, recorded in Map Book 3, page 94, <br />in the Clerk's Office of the Court of Hustings for the <br />City of Portsmouth. be, and the same is, hereby <br />,vacated' however this vacation shall in no wise <br />~Paffect the dedication of sa~d. area for the other <br /> purposes expressed. <br /> <br /> Adopted/by the Council of the City of PortSmouth, <br /> at: a meeting held October 9, 1962, <br /> <br /> ~este: <br /> <br /> Clerk; <br /> <br /> <br />
