AN ORDINANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH D~DER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 258 OF THE ACTS OP ASSEMBLY OF 1958, SAID PROPERTY BEING NECESSARy FOR IMPROVEMENT OF A PORTION OF PORTSMOUTH BOULEVARD~ ROUTE 337, PARCEL 172. WHEREAS~ the City of Portsmouth has found it to be necessary to widen and otherwise improve a portion of Portsmouth Boulevard, Route 337, under a Federal Urban Aid Program whereby it is the responsibility of the said City to acquire all necessary additional property; and WHEREAS, the City of Portsmouth has not been able to purchase certain property necessary to this project because the owners thereof are not able to make a voluntary conveyance thereof for the reason that the owner of the fee simple estate is an in- fant; and WHEREAS, advancement reasonably if the said property possible. of the work will be delayed un- is not made available as soon as NOW0 THEREFORE, be it ordained by the Council of the City of Portsmouth, Virginiar that the City Attorney is directed to institute eminent domain proceedings~ employing counsel for that purpose, against the property hereinafter described, in accordance with and pursuant to Section 23-f of the Charter of the City of Portsmouth (Chapter 258 of the Acts of Assembly of 1958), and that the sum of $4,000.00 be deposited to the credit of the court as provided by law to compensate the owners thereof: (a) The owners of record are as follows: Edna J. Carroll, life tenant, and Patricia Rose Carroll, remainderman. (D) The interest to be acquired is the fee simple estate in and to the property hereinafter described as parcel 172 Z, and a two year construction ease- ment in and to the property hereinafter described as Parcel 172 y. (c) The approximate area of Parcel 172 Z is 0.10 acre, and of Parcel 172 Y is 25 square feet. (d) The description of the property is as follows: That certain parcel of land situate in the City of Portsmouth, Virginia, more particularly described as follows:
