AN ORDINANCE TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY BY THE CITY OF PORTSMOUTH D~DER EMINENT DOMAIN <br />PROCEEDINGS PURSUANT TO CHAPTER 258 OF THE ACTS OP <br />ASSEMBLY OF 1958, SAID PROPERTY BEING NECESSARy FOR <br />IMPROVEMENT OF A PORTION OF PORTSMOUTH BOULEVARD~ <br />ROUTE 337, PARCEL 172. <br /> <br /> WHEREAS~ the City of Portsmouth has found it to be <br />necessary to widen and otherwise improve a portion of Portsmouth <br />Boulevard, Route 337, under a Federal Urban Aid Program whereby it <br />is the responsibility of the said City to acquire all necessary <br />additional property; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase certain property necessary to this project because the <br />owners thereof are not able to make a voluntary conveyance thereof <br />for the reason that the owner of the fee simple estate is an in- <br />fant; and <br /> <br /> WHEREAS, advancement <br />reasonably if the said property <br />possible. <br /> <br />of the work will be delayed un- <br />is not made available as soon as <br /> <br /> NOW0 THEREFORE, be it ordained by the Council of the <br />City of Portsmouth, Virginiar that the City Attorney is directed <br />to institute eminent domain proceedings~ employing counsel for <br />that purpose, against the property hereinafter described, in <br />accordance with and pursuant to Section 23-f of the Charter of <br />the City of Portsmouth (Chapter 258 of the Acts of Assembly of <br />1958), and that the sum of $4,000.00 be deposited to the credit of <br />the court as provided by law to compensate the owners thereof: <br /> <br /> (a) The owners of record are as follows: <br /> Edna J. Carroll, life tenant, and Patricia Rose <br /> Carroll, remainderman. <br />(D) The interest to be acquired is the fee simple <br /> estate in and to the property hereinafter described <br /> as parcel 172 Z, and a two year construction ease- <br /> ment in and to the property hereinafter described <br /> as Parcel 172 y. <br />(c) The approximate area of Parcel 172 Z is 0.10 acre, <br /> and of Parcel 172 Y is 25 square feet. <br />(d) The description of the property is as follows: <br /> <br /> That certain parcel of land situate in the City <br />of Portsmouth, Virginia, more particularly described <br />as follows: <br /> <br /> <br />
