Mt ORDINANCE TO VAC3XE THE WESTEPJ4 ~4REE FEET OF A PORTION <br />OF A SEWER EASEMENT CROSSING LOT 47 OF NORTfi TRUXTON. <br /> <br /> WHEREAS, by deed dated July ls 1947, W. C. Erocker~ et al, con- <br />veyed to the City of Portsmouth~ among other things~ a fifteen foot sewer <br />easement along the eastern side of Lot 47, as shmm on the Plat of North <br />Truxton, recorded in Plat Book 2, pages 37 through 39, in the Clerk's <br />Office of the Court of Hustings for the City of Portsmouth; and <br /> <br /> ~HEREAS~ the western three feet of the northern 79 feet of said <br />easement are not required by or necessary to the purposes of the City of <br />Portsmouth; and <br /> <br /> WHEREAS, certain improvements are to be constructed within the <br />area of said easem~nt~ thereby preventing finmncing of the said improvements, <br />mhd the mmer thereof has requested the vacatxon of that portion of the ease- <br />ment not needed by the City. <br /> <br /> NOW THEREFORE, Be it ordained by the Council of the City of Ports- <br />mouth, Virginia, that the western three {eet of the northern 79 feet of that <br />certain fifteen foot sewer easement running along the eastern side of Lot 47~ <br />as shown on the Plat of North Truxton, recorded in Plat Book 2, pages 37 <br />through S9, in the Clerk's Office of the Court of Hustings for the City of <br />Portsmouth~ be, and the same is hereby vacated. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a <br />meeting held Augus~ 27, 1963. <br /> <br />City Clerk <br /> <br /> <br />
