and by such other terms and conditions as may be expressed in the <br />consent to assign or sublet. <br /> <br /> 9. The Lessee agrees that it will collect and pay over to the <br />Lessor such ara~ement taxes as are levied by ordinance. If at any <br />time the existing arm~sen~nt tax is reduced, repealed or otherwise <br />becomes, non-operative as to admissions to auy event promoted by <br />Lessee, the Parties hereto shall negotiate an additic~al rental to <br />be paid hereunto, not to exceed the amusement tax presently appli- <br />cable, and in the event the parties fail to agree upon such addi- <br />tional rental, this agreement of lease shall terminate and the <br />Lessee shall sturrender the premises thirty days from the giving of <br />no~ice thereof by the City to the Lessee. <br /> <br /> 10. The Lessee agrees that no alteration of any portion of the <br />demised premises shall be undertaken without the written consent of <br />the Lessor having been first obtained, and the Lessee agrees that <br />it will reimburse the Lessor for any damage done to the demised <br />pre~v~ises by reason of the willful or negligent acts of Lessee, its <br />licensees and/or agents, servants and employees of the Lessee or <br />its licensees. At the expiration of the term of this lease the <br />Lessee agrees to sttrrender the demised premises in good condition, <br />reasonable wear and tear excepted. <br /> <br /> ll. It is expressly understood and agreed that the Lessor <br />reserves the right unto itself and its assi&as to the free exclu- <br />sive use and occupancy of the demised premises during the tern <br />hereof at such times as not to conflict with league games scheduled <br />by Lessee. <br /> <br /> 12. Subjecv to the previsions of Paragraph l0 above, ~.~L. utenance <br />of the improvements to the real property which shall include, but <br />nov be limited to, collection of all debris, rubbish and other forei~. <br />matter wit~bin the stadium area and its subsequent removal therefrmn, <br />shall be the responsibility of the Lessor. <br /> <br /> 13. It is expressly understood and agreed between the Lessor and <br />Lessee that the execution of this agreement operates to cancel any <br />and all other previously executed leases between them conc~tng <br />Frank D. Lawrence Stadium. <br /> <br /> 14. The Lessee shall have the right and privilege of r~newLng this <br />lease for the term provided for in Paragraph 1 for seven a~tional <br />and consecutive years; provided, however, in order to beco?~ enti- <br />tled to each such.renewal the Lessee must own a franchise Lu an <br />organized professmonal baseball league foF the baseball season next <br />ens~ging. Unless the Lessee gives written notice to the C~ty.
