Fireworks shall mes~ ~ud include any combustible or explosive cm~oositi~, or ~ny substance or co~ination of substances~ or article prepared for the purpose of producing a visible or an audible effect by combustion, erptosion, defl~eration or detonation, and shall in- clmde blank cartridges, roy pistols, toy c~r~ons, toy caues, or toy ~ns in which e~s!osives ~e use~ ~ the type of balloons whioh require £ire ~derueath ~o pr%~el the sa~, ~irecrackers, torpedoes~ skyrockets~ Roan candles, ~aygo bombs, sparkters~ or other devices of like con- svruction ~d any devices contairnLug any explosive or flammable pou~t ~ or any tablets or other devices containing any ~xplosive sub- s~ance, except that t~he term"firewo~s" shall not include auto psper c~os contaLui~g not in excess of an average ~f ~wenty-five hundredths of a grain of explosive content per cap manufactured i~ accordance ~.~th the Interstate Commerce Con~issio~ Regulations for packing ~nd shipping as provided therein~ and toy pistols~ toy Canes~ toy g~ns or o~her devices for use of such caps~ the sale and use of ~4oich shall be permitted at all times. Pyrotechnics (special fire- works) shall co~ply ~th the applicable provisions of Ar$1eie 12 of the Fire~ Prevention Code. Sec. 11-25. Manufacture, Sale and Discharge of Fireworks° (a) ~ae man~acture of fireworks is prohibited within the City of Portsmouth. (b) Except as here~after provided it shall be unlawful for ~ay person to soore, to offer for sale, expose for sale, sell at re- tail, or use or e~plode any fireworks; provided that the ~nief of the Fire Division and the ~aief of Police may adopt reasonable rules and regulations for the grantL~_g of p~r~its for supe~r~'s, ed public dis- plays of fireworks by mnni?ipalit~es, fair assocmatm~o_ns, amusement parks, and other orgs~uizations or group of individuals, Such pe~mt ms~j be ~anted upon application to said Chief of the Fire Division and the C~ief of Police and upma the filing of a bond by the applicant as provided hereinafter. Every such display shall be handled by a competent operavor licensed or certified as ~o competency by the Chief of the Fire Division and the ~nief of Police and shall be of such positioa, character, ~nd so loc~ted~ discharged or fired as in the opinion o£ the C~zief o£ the Fire Division.and of the Chief of Police, a~%er proper inspection, shall not be hazardous to property or endanger shy person or persor~0
