Sec. 11-23. Appeal to C~_ty Courmil. <br /> <br /> In connection with the Fire Prevention Code, 1965 Edition, <br />adopted by Section 11-19, whenever the ~o_ief of the Fire Department <br />shall disapprove an application or refuse to grant a license or per- <br />,,mit applied for, or when it is claimed that the provisions of such <br />i?ire Prevention Code, 1965 Edition, do not apply or that the true in- <br />~en~ and metaling of the Code have been misconstrued or wrongly inter- <br />preted, the applicant rosy appeal from the decision of the Chief of <br />the Fire Deps~tment to the City Council ~tlnin thirty days from the <br />date of the decision frmm which the appeal is tskeno <br /> <br />Sec, 11-24. Penalty for violati~o <br /> <br /> ,~/ person ~o ~hall violate ar~- of the provisions of the <br />Fire Prevention Code ~ 1965 Editim~ adopted by Section 11-19, or shall <br />fail to comply therewith~ or who shall violate or fail to comply with <br />any other ~.de theremnder~ or ~.~o shall bt~ild in -violation of any <br />detailed statement of speci~eations or pLmns submitted and approved <br />thereunder, or any certificate or permit issued thereunder, and z~rom <br />~.~zich no appeal has been taken~ or who shall fail to co~oly vrlth such <br />an order as affirmed or modified by the City Council or by a court of <br />cm,~petent jurisdiction, withi~ the time fixed herein, shall severally <br />for each smd every such violation snd noncompliance, respectively, be <br />guilty of a misdemeanor, pt~zish~ble by a fine of not less than ten <br />dollars nor .~ore than five hundred dollars or by i~prisonment for not <br />more than tv~lve months or by both such fin~ and i~prisonment, The <br />~mposition of one penalty for any violation shall not excuse the vio- <br />lation or permit it to continue; mad all such persons shall be re- <br />quired to correct or remedy stch violations or defects w~thin a <br />reasonable time; and ~en not otherwise specified~ each ten days that <br />prohibited conditions are maintained shall constitute a separate <br />offense, <br /> <br /> 7ne application of the above penalty shs]] not be held to <br />prevent the enforced removal or prob~ibited conditions, <br /> <br />~ICLE IV <br /> <br />Sec. 11-23. Scope° <br /> <br /> (a) This article shall apply to fireworks as hereinafter <br />defined, except as provided in section (b) hereof. <br /> <br /> (b) Nothi~ng in tt~is article shall be cormtr~ed to prohibit <br />m~y resident wholesaler~ dealer, or jobber to sell at wholesale such <br />fireworks as are not herein prohibited~ or the sale of any kind of <br />fireworks provided the same are to be shipped directly out of state <br />i_n accordance ~rith the Interstate Commerce Commission Regt~lations <br />covering the ~ransportation of explosives and other dangar~ articles <br /> <br />-3- <br /> <br /> <br />
