Be it ordained by the Council of the City of Portsmouth, Virginia, that Sections 26-37 and 26-38 of the Code of the City of Portsmouth, Virginia, 1961, be amended and reordained to read as follows: Sec. 26-37. Refund of contributions upon with- drawal or death before retirement. (a) If a member has ceased to be an employee, otherwise than by death, or by retirement under the provisions of this article, he shall be paid, on demand, but not later than ninety days there- after, the amount of his accumulated contributions reduced by the amount of any retirement allowance previously received by him under any of the.pro- visions of this article; provided that if the mmount of the member's accumulated contributions prior to such reduction is less than ten dollars, no such pa~ent shall be made and the member's accumulated contributions shall be transferred from the members' contribution account to the retirement allowance account as provided in section 26-28 (f). Should such a member die after ceasing to be an employee but before retirement and before receiving the amount of his accumulated contribu- tions, the ~mount of his acc~nulated contributions reduced by the mnount of any retirement allowance previously received by him under any of the pro- visions of this article shall then be payable in a l~mp s~m in accordance with section 26-42~ subject ~o the provisions aforesaid ~ith respect to ~mounts of accumulated contributions of less than ten dollars.
