AN ORDtNfuNCE TO A~.IEND SECTIONS 26-37 fuND 26-38 OF <br />THE CODE OF THE CITY OF PORTS~4OO~F~-t, VIRGINIA, 1961, <br />TO PROVIDE TttAT REFb~'DS OF LESS TH,~N TEN DOLLARS <br />}gILL NOT BE MADE. <br /> <br /> Be it ordained by the Council of the City of <br />Portsmouth, Virginia, that Sections 26-37 and 26-38 <br />of the Code of the City of Portsmouth, Virginia, <br />1961, be amended and reordained to read as follows: <br /> <br />Sec. 26-37. Refund of contributions upon with- <br /> drawal or death before retirement. <br /> <br /> (a) If a member has ceased to be an employee, <br />otherwise than by death, or by retirement under <br />the provisions of this article, he shall be paid, <br />on demand, but not later than ninety days there- <br />after, the amount of his accumulated contributions <br />reduced by the amount of any retirement allowance <br />previously received by him under any of the.pro- <br />visions of this article; provided that if the <br />mmount of the member's accumulated contributions <br />prior to such reduction is less than ten dollars, <br />no such pa~ent shall be made and the member's <br />accumulated contributions shall be transferred <br />from the members' contribution account to the <br />retirement allowance account as provided in section <br />26-28 (f). Should such a member die after ceasing <br />to be an employee but before retirement and before <br />receiving the amount of his accumulated contribu- <br />tions, the ~mount of his acc~nulated contributions <br />reduced by the mnount of any retirement allowance <br />previously received by him under any of the pro- <br />visions of this article shall then be payable in <br />a l~mp s~m in accordance with section 26-42~ <br />subject ~o the provisions aforesaid ~ith respect <br />to ~mounts of accumulated contributions of less <br />than ten dollars. <br /> <br /> <br />
