;24 ORDINANCE TO ;J~) THE CODE OF THE CIYY OF PORTSM0bT~H~ VIRGINrIA, <br />1961, BY ADDING TO CH~ 13 Tk~OF, A N-E~ ~RTICLE N-o~s~ IV, <br />CONSISTLNG OF EIGH'~ SECTIONS, REGULATING I~JqDFILL OPER~TIONS. <br /> <br /> Be it ordained by the Cou~ecil of the City of Portsmouth, Virginia, <br />that the Code of the City of Portsmouth~ Virginia, 1961, be amended by <br />adding to Chapser 13 thereof, a new article numbered IV, consistirs of <br />eight sections, such article to read as follows: <br /> <br />Article IF. L%XDFILL OPERATIONS. <br /> <br />Sec. 13-28. Definitions <br /> <br /> As used in this article the followir~ te~ shall be construed as <br />~dicated below: <br /> <br /> (a) "Person" includes an mnamvn_dual, a corporation or other legal <br />entity, a partnership and. ~ny unincorporated association, ar~ shall include <br />both singular ~ plural but in no case shall the provisions of this article <br />be construed to apply to ~ny agency or department of the United States of <br />~merica, the Cmv~onwealth of Virginia or the City of Portsmeutln. <br /> <br /> (b) "Garbage" shall mean all am3~l and vegetable ~,~ster and all <br />putrescible matter. <br /> <br /> (c) "Refuse" sP~ll mean all },taste substance% except garbage~ including <br />both combustible a~d noncu~ustible ~'astes. <br /> <br /> (d) "Combustible waste!' sN~ll mean all ~aste substances capable of <br />incineration or burning but excluding explosive or hi~nly .flan~ble ~teria!. <br /> <br /> (e) "Noncombustible w~ste" s2aall memn all other ,~ste substance not <br />capable of incineration or burni~ including ashes~ glass, metal, earthenware <br />and the like. <br /> <br /> (f) "~mndfill'~ sb~ll meem a type of operation in ~_ich refuse is <br />deposited in a pit orexcavation or ~oon open l~nd, ~nd then is covered by <br />a layer of es_~th, ashes~ or other suitable cov-erirg m~terial to adepth of <br />at least two feet, <br /> <br />Sec. 13-29.
