unit, which, in th~ Judgment of the planning Commission provide <br />adequate public spaces and improvements for the circulation, <br />recreation, light, air, and service needs of the tract, whe~ <br />fully developed and populated, and which also provide such <br />covenants or other legal provisions as will assure conformity <br />to and achievement of the plan. <br /> <br /> (c) In gr~nting variances and modifications, the <br />planning commission may require such conditions as will, in its <br />Judgment, secure substantially the objectives of the standards <br />or requirements so varied or modified. <br /> <br />Sec. 32-21. Fees and penalties. <br /> <br /> (a) There shall be a charge for the examination <br />and review of every subdivision plat submitted to the planning <br />commission. This fee shall be in the amount of $5.00 for each <br />lot contained in the subdivision, with a minimum charge of <br />$25.00 for each plat containing a dedicated public street. This <br />fee shall be paid at the time the application is made for ap- <br />proval of the final subdivision plat. <br /> <br />- (b) Any owner or,proprietor of any tract of land <br />who ~ubdivided that tract of land and who violates any of the <br />provisions of this Chapter, shall be guilty of a misdemeanor, <br />to ~e punishable by a fine of no~ less than ten dollars and not <br />mor~ Shan $250.00, and each day after the first during which <br />sucb'violation shall continue, shall constitute a separate <br />vi~lation. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br /> ginia, at,a meeting held May 12: 1970- <br /> <br />T~ste: <br /> <br />C_.ty Clerk <br /> <br /> <br />
