(7) Subdivision means the division of a parcel of <br />!and into Two or more lots or parcels for the purpose of trans- <br />fer Of ownership or of building development~ including all changes <br />in street or lot lines; provided, however that divisions'of land <br />into parcels of ~hree acres or more not involving any new street <br />or easement shall not be deemed a subdivision; and Further pro- <br />vided that any transaction to which the city of Port~mouth or <br />the Commonwealth of Virginia is a party shall not demand a sub- <br />division. ~ <br /> <br />Sec. B2-B. Preparation and recordation of subdivision p a~s. <br /> <br /> Ca) Any owner or proprietor of any tract of land, <br />which is located within the city of Portsmouth, who subdivides <br />such tract, or who causes any public streets, alleys, or public <br />areas to be created, shall cause a plat to be made of such sub- <br />division and streets, alleys, and public areas, and shall also <br />cause such plat to be recorded in the office of the clerk of the <br />Court of Hustings for the City of Portsmouth. Such plat shall <br />be prepared in accordance with the requirements of this chapter. <br /> <br /> (b) The clerk of the aforesaid court shall not <br />file or record any such plat or any copy thereof required by <br />this chapter to be recorded until such plat or copy thereof <br />shall have been approved, and such approval evidenced thereon, <br />in accordance with the provisions of this chapter. <br /> <br /> (c) No building permit shall be issued for the <br />erection of any structure or building to be located in any sub-. <br />division within the city, a plat whereof is required to be re- <br />corded pursuant to the provisions of this chapter until such <br />~lat shall have been admitted to record as herein provided. <br /> <br /> (d) Every such plat shall be prepared by a civil <br />engineer or a surveyor duly licensed by the.Commonwealth of Vir- <br />ginia, who shall endorse upon each such plat a certificate <br />signed by him setting forth the sources of the title of the <br />owners of the land subdivided: and the place of record of the <br />last instruments in the chain of title. When the plat is of <br />land acquired from more than one source of title, the outlines <br />of the several trac~s shall be indicated upon such pla~. <br /> <br /> (e) Every such plat shall contain a statement to <br />the effect that the subdivision as it appears in the plat is <br />with the free consent and in accordance with the desire of the <br />~ners, proprietors~ and trustees, if any. -The statement shall <br />be signed by the owners~ proprietors and trustees, if any, and <br />shall be duly acknowledged before some officer authorized to <br />take acknowledgement ~f deeds. - , <br /> <br /> (f) No reservation of muy fee in afly street or <br />o~her l~nm to be dedicated for puhlzc use shall be made by the <br />subdivider~ s an the <br /> <br /> <br />
