(7) Subdivision means the division of a parcel of !and into Two or more lots or parcels for the purpose of trans- fer Of ownership or of building development~ including all changes in street or lot lines; provided, however that divisions'of land into parcels of ~hree acres or more not involving any new street or easement shall not be deemed a subdivision; and Further pro- vided that any transaction to which the city of Port~mouth or the Commonwealth of Virginia is a party shall not demand a sub- division. ~ Sec. B2-B. Preparation and recordation of subdivision p a~s. Ca) Any owner or proprietor of any tract of land, which is located within the city of Portsmouth, who subdivides such tract, or who causes any public streets, alleys, or public areas to be created, shall cause a plat to be made of such sub- division and streets, alleys, and public areas, and shall also cause such plat to be recorded in the office of the clerk of the Court of Hustings for the City of Portsmouth. Such plat shall be prepared in accordance with the requirements of this chapter. (b) The clerk of the aforesaid court shall not file or record any such plat or any copy thereof required by this chapter to be recorded until such plat or copy thereof shall have been approved, and such approval evidenced thereon, in accordance with the provisions of this chapter. (c) No building permit shall be issued for the erection of any structure or building to be located in any sub-. division within the city, a plat whereof is required to be re- corded pursuant to the provisions of this chapter until such ~lat shall have been admitted to record as herein provided. (d) Every such plat shall be prepared by a civil engineer or a surveyor duly licensed by the.Commonwealth of Vir- ginia, who shall endorse upon each such plat a certificate signed by him setting forth the sources of the title of the owners of the land subdivided: and the place of record of the last instruments in the chain of title. When the plat is of land acquired from more than one source of title, the outlines of the several trac~s shall be indicated upon such pla~. (e) Every such plat shall contain a statement to the effect that the subdivision as it appears in the plat is with the free consent and in accordance with the desire of the ~ners, proprietors~ and trustees, if any. -The statement shall be signed by the owners~ proprietors and trustees, if any, and shall be duly acknowledged before some officer authorized to take acknowledgement ~f deeds. - , (f) No reservation of muy fee in afly street or o~her l~nm to be dedicated for puhlzc use shall be made by the subdivider~ s an the
