ceased to be a member thereof. <br /> <br />Sec. 26-31o Service retirement. <br /> <br /> (a) Normal retirement: Any member in service <br />at his normal retirement date may retire at any time <br />then or thereafter upon written notification to the <br />board, made by such member or his appointing authority, <br />setting forth at what time the retirement is to become <br />effective; provided, that such effective date shall be <br />after his last day of service, but shall not be more <br />than ninety days prior to or subsequent to the filing of <br />such notice. <br /> <br /> (b) Early retirement: Any member who is in <br />service on or after his fifty-fifth birthday may retire <br />upon written notification to the board, made by the <br />member or his employer, setting forth at what time the <br />retirement is to become effective; provided, that such <br />effective date shall be after his last day of service <br />and after the filing of such notice but shall not be more <br />than ninety days subsequent to the filing of such notice. <br /> <br /> (c) Deferred retirement for me~ers terminating <br />service: Any me~er having left the service after the <br />attainment of age fifty and after having completed twenty <br />years of creditable service, may retire under the pro- <br />visions of subsection (a) of this section, or under the <br />provisions of subsectionS(b) of this section except that <br />any requirements as to the me~er being in service shall <br />not apply. <br /> <br /> (d) Mandator3 retirement: Any member remaining <br />in service after his normal retirement date who attains <br />the maximum retirement age shall be retired forthwith. <br /> <br />Sec. 26-69.1. <br /> <br />Inclusion of service in the Police <br />or Fire Department of an annexed <br />area as creditable service. <br /> <br /> Any continuous period of service with the Police <br />or Fire Department of a county or city from which the City <br />of Portsmoutk~annexed territory shall be included as cred- <br />itable service; provided such employee was (1) a paid full- <br />time employee of such County or City Police or Fire Depart- <br />ment, (2) a resident of the annexed territory, and (3) <br />transferred directly from such County or City Department <br />between the time the final annexation decree was entered <br />and sixty days after the date the annexation became effective; <br /> <br /> <br />
