ceased to be a member thereof. Sec. 26-31o Service retirement. (a) Normal retirement: Any member in service at his normal retirement date may retire at any time then or thereafter upon written notification to the board, made by such member or his appointing authority, setting forth at what time the retirement is to become effective; provided, that such effective date shall be after his last day of service, but shall not be more than ninety days prior to or subsequent to the filing of such notice. (b) Early retirement: Any member who is in service on or after his fifty-fifth birthday may retire upon written notification to the board, made by the member or his employer, setting forth at what time the retirement is to become effective; provided, that such effective date shall be after his last day of service and after the filing of such notice but shall not be more than ninety days subsequent to the filing of such notice. (c) Deferred retirement for me~ers terminating service: Any me~er having left the service after the attainment of age fifty and after having completed twenty years of creditable service, may retire under the pro- visions of subsection (a) of this section, or under the provisions of subsectionS(b) of this section except that any requirements as to the me~er being in service shall not apply. (d) Mandator3 retirement: Any member remaining in service after his normal retirement date who attains the maximum retirement age shall be retired forthwith. Sec. 26-69.1. Inclusion of service in the Police or Fire Department of an annexed area as creditable service. Any continuous period of service with the Police or Fire Department of a county or city from which the City of Portsmoutk~annexed territory shall be included as cred- itable service; provided such employee was (1) a paid full- time employee of such County or City Police or Fire Depart- ment, (2) a resident of the annexed territory, and (3) transferred directly from such County or City Department between the time the final annexation decree was entered and sixty days after the date the annexation became effective;
