AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTS- MOUTH, VIRGINIA, 1961, BY AMENDING SECTIONS 26-23 AND 26-31 THEREOF AND BY ADDING THERETO NEW SECTIONS NUMBERED 26-23.1, 2~-24.1 AND 26-69.1, PERTAINING TO SERVICE RETIREMENT AND CREDITABLE SERVICE IN THE PGRTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM AND THE PORTSMOUTH FiRE AND POLICE RETIREMENT SYSTEM. Be it ordained by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, Vir- ginia, 1961, be amended by amending sections 26-23 and 26-31 thereof end by adding thereto new sections numbered 26-23.1, 26-24.1 and 26-69.1, such amended and new sections to read as follows: Sec. 26-23. Effect of cessation of member- ship. When membership ceases, an employee shall thereafter lose all right to any retirement allowance or benefits under %his article arising from service prior to the date of such cessation of membership, ex- cept as hereinafter provided. Sec. 26-23.1. Inclusion of former service as creditable service. Any person who was formerly a member of the system and who ceased to be a member by reason of with- drawing his contributions upon becoming a member of Virginia Supplemental Retirement System may be restored to membership in the system and have his previous time as a member counted as creditable service provided [1) he has remained in continuous servzce with the city and a combined city-state office and (2) he-repays to the system the amount of contributions he previously with- drew. Sec. 26-24.1. Inclusion of service under the Virginia Supplemental Retirement System as creditable service.
