<br />EIGHT NEW SECTIONS N~4m~{ED 31-35.1, 31-37.t, 31-37.2, 31-37.3,
<br />31-37.4, 31-37.5, 31-37.6, AND 31-38.1 PERUAINING TO THE ISSUANCE
<br />OF PERMITS TO EXCAVATE W££~IN THE CITY'S STR~ kND RIGHT OF ~AYS.

<br /> Be it orS~ned by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That the Code of the City of Portsmouth, Virginia,
<br />1961, be amended by amercing Sections 22-1, 31-4, 31-5, 31-33, 31-34,
<br />31-35, 31-36, 31-37, 31-38, and 31-39 thereof, and by adding thereto
<br />eighf new sections numbered 31-35.1, 31-37.1, 31-37.2, 31-37.3, 31-37.4,
<br />31-37.5, 31-37.6 and 31-38.1, such amended and new sections to read
<br />as follows:
<br />
<br />Section 22-1. Pexmit required for erection of post or pole.
<br />
<br /> NO person shall erect a post or a pole in any of the city's
<br />streets or right of ways unless he first obtains a penmit therefor
<br />as re~,~ed by Section 31-33 from the city engineer.
<br />
<br />Section 31-4. Lowering curbs; private driveways ~r ra~ps.
<br />
<br /> No person shall lower the curb on any street, or lay any
<br />private driveway or ramp. crossing any sidewalk of the city without
<br />first obtair~, a permit therefor as required by Section 31-33 frcm
<br />the city engineer. Ail such driveways cr ramps shall be constructed
<br />and curbs lowered accordin~ to plans to be fur~hed by the city
<br />engineer, for which plans the applicant shall pay fifty cents; and
<br />under the superviszon of the city engineer, subject to such cunditions
<br />as he may prescribe as to materials used and manner of construction.
<br />Ail such driveways or ramps shall be fully paved over their entire
<br />width bet~ean the edge of the pav~aent of the street and the property
<br />line of the property to be served by such driveway or ramp. All
<br />paving and repaying, where necessary, shall be done at the expense of
<br />the person receiving such p~rmit. It shall be the duty of the owner
<br />of such driveway at all times to keep the sidewalk crossed by such
<br />driveway or ramp in good repair at his own expense.

<br />Section 31-5. Cutting stone curbing.
<br />
<br /> No person S]"~.~11 C~t the stone curbing of the city, without
<br />first having obtained pen~ission of the city engJ_neer so to do.
<br /> Ail cutting of curbin~ shall be done at the expense of the
<br />owner or Occupier of the property, for whose benefit the w~rk is tm be
<br />done, and the sa~e must be execute~ under the supervision, and With the
<br />approval of the city er~lineer.
