AN ORDINANCE TO ~4END THE CODE OF THE CITY OF PORTSMOUTH, VIR- GINiA, 1961, BY ADDING THERETO A NEW SECTION NUMBERED 19-19.1, MAKING IT UNLAWFUL TH MAINTAIN OR FREQUENT A HOUSE OR OTHER PLACE FOR THE PURPOSE OF KEEPING OR DISPENSING NARCOTICS, DRUGS OR OTHER CONTROLLED PARAPHERNALIA ILLEGALLY. Be it ordained by the Council of the City of Ports- mouth, Virginia: 1. That the Code of the City of Portsmouth, Virginia, 1961, be amended by adding thereto a new section numbered 19-19.1, such new section to read as follows: Sec. 19-19.1. Disorderly house - narcotics. (a) It shall be unlawful for any person in the city to keep, maintain or operate for himself or any other person, any store, shop, warehouse, dwelling, building, vehicle, boat, aircraft, or any place whatsoever, which is resorted to by persons for the purpose of illegal use of narcotics, controlled drugs or controlled paraphernalia, or which is used for the il- legal keeping or dispensing of narcotics, controlled drugs or controlled paraphernalia. Such place shall be deemed a common nuisance. Each day's keeping of any such place shall consti- tute a separate offense, and in any prosecution for this of- fense, the general reputation of such place may be proved. (b) It shall be unlawful for any person to frequent any such common nuisance or visit any such place for the purpose of illegally buying, dispensing or using narcotics, controlled drugs or controlled paraphernalia. Mere presence in any such place where narcotic~, controlled drugs, or controlled pgra- phernalia are being illegally displayed, dispensed or used, shall be prima facle evidence of lntent to vlolate thls seotlo .
