AN ORDINANCE TO CLOSE A 12 1/2 FOOT ALLEY BETWEEN EDISON AVENUE AND BALDWIN AVENUE ALONG THE REAR LOT LINE OF PROPERTIES ON THAT BLOCK FRONTING ON DEEP CREEK BOULEVARD. WHEREAS, David M. Kimberlin and Nellie F. Kimbertin, Mrs. Ruth Trotman, Mrs. Katie B. Porter, Lyndall G. Jones and Virglnia T. Jones, Clarence O. Garrett and Mary A. Garrett, have made application to vacate and close the hereinafter des- cribed portion of a certain alley; and WHEREAS, by resolution of this Council adopted Octo- ber 12, 1971, viewers were appointed pursuant to Section 15.1- 364 of the Code of Virginia, 1950, as amended, to view the hereinafter described portion of the said alley and to report in writing whether in their opinion any, and if any, what in- convenience would result from the discontinuing of the below described alley; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from clos- ing and discontinuing said alley; NOW, T}~REFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that all that certain strip of land, situate in the City of Portsmouth, Virginia, and described as the area shown as a twelve and one-half foot (12 1/2) alley lying between the rear of Lots 29 through 34, both inclusive, in Block "C", as shown on the Plat of Highland Park, duly re- corded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Map Book 16, at page 61, and the western side lines of Lots 27 and 28 in said Block and extend- ing from Baldwin Avenue south to Edison Avenue be and the same is hereby closed and vacated as a public alley. Adopted by the Council of the City of Portsmouth~ Virginia, at a meeting held December 7~ 1971. Teste: City Clerk
