or in~rovement which shall include, but shall not necessarily be limited .mo the general design, arrange~.~ent, texture, materials, planting and color proposed to be used in the location, construct- ion, reconstruction~ alteration or repair of the building, structure or improvement and the type of windowsf exterior doors, lights, landscaping~ parkin9 signs and other exterior fixtures and appurt- enances which will be subject to public view from a public way, or othe~ public place. Upon the filing of such application with the Building Official, he shall immediately transmit it with such ~!ans and specifications to the co~ission. Section 9-8. Approval or Disapproval of Plans .and Specifications; Issuance of Certificate of kp~roprmateness~ Issuance of Permit. Upon recezpt of an application for a permit required by Section 9-5 and the plans and specifications, the co~ission shall confer with the applicant for the building permit, and shall approve or disapprove such plans and specifications and, if approved, shall issue a certificate of appropriateness therefor with or without conditions, or with such modifications of the plans and specifica- tions as the commission deems necessary to execute the purposes and objectives declared in Section D-i and to require compliance with the regulations and restrictions set out in this article~ otherwise, the com~ission shall 'reject s.uc~ plams and specifications and shall not issue the certificate of appropriateness. The failure of the commission to approve or disapprove such plans and specifica- tions with or without conditions or ~odifications, within sixty days from the date of application for the building permit shall be deemed to constitute approval of the plans and specifications as submitted, and the Building Official shall issue the permit pro- vided the work to be done under the permit complies with the re- quirements of the Building Code and other ordinances and laws applicable or relating thereto. Section 9-9. Considerations to be Taken Prior to Issuance of Certificate of Appropriateness Generally. Be£ore a certificate of appropriateness is issued by the com~ission and upon conferring wiDh the applicant for the building permit, the con~ission, in addition to other pertinent factors which may be involved in the e~[ecution of the purposes and objectives declared in Section 9-1 shall consider: (a) the historical or architectural value and signif- icance of the building or structure and its relationship to or congruity with tile historic value of the land, place and area in the Historic District upon which it is proposed to be located, constructed, reconstructed, altered or repaired; -5-
