AN ORDINA~CE TO AMEND THE CODE OF THE CITY OF PORTS- MOUTH, VIRGINIA 1961, BY A~DtNG THERETO A NEW SECTION NUMBERED 13-19.1, AND BY A~NDING SECTIONS 13-18, 13-19, AND 13-27 THERE- OF ALL RELATING TO THE SERVICE CHARGES IMPOSED ON D?~LLING UNITS AND OTHER ESTABLISHMENTS TO ASSIST IN DEFP~YING THE EXPENSES OF TRASH AND GARBAGE COLLECTION AND DISPOSAL. Be it ordained by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, Virginia, 1961, be amended by adding thereto a new Section numbered 13-19.1 and by amending Sections 13-18, 13-19, and 13-27 thereof, amended sections to read as follows: Section 13-18. Definitions. For the purposes of this article, the following terms shall have the meaning given herein: (a) Business and commercial establishments. and commercial establishments" are premises wherein: "Business (i) There Ks carried on any business, profession or occupation subject to the license tax ordinance of the city. (2) There is carried on any broadcasting, publish- ing, manufacturing or commercial activity or process. (b) Director. "Director" shall mean the director of public works of the city or his authorized representative. (c) Dwelling. Any building which is wholly or partly used or intended to be used for living or sleeping by human occupants. (d) Dwelling unit. Any room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating. (e) Garbage. "Garbage" shall mean putrescible animal and vegatable wastes resulting from the handling, preparation, cook- ing and consumption of food. (f) Operator. An "operator" is the person, firm, corpo- ration or association operating any business or industrial estab- lishment as defined herein, as distinguished from the owner of the premises involved.
