upon the faithful performance of his duties. <br /> <br />Section 7-5.1. Fees and compensation of High Constable. <br /> <br /> (a) The high constable shall receive such fees as are <br />now or may hereafter be prescribed by law for sheriffs. The <br />fees collected by the high constable shall be paid into the <br />treasury of the city regularly, but not less than once a month. <br />All fees and commissions of every kind and character, whether <br />payable by the Commonwealth, the United States, or by private <br />persons, firms or corporations, now or hereafter receivable by <br />law or ordinance by the high constable, shall continue to be <br />paid to and collected by him and shall be paid into the treasury <br />of the city, except that the city shall not be required to pay <br />to him any fees or commissions for services performed for such <br />city. <br /> <br /> (b) The high constable shall be paid a salary out <br />of the treasury of the city as provided by law, which salary <br />shall be an full compensation for his services and shall be <br />in lieu of the retention by him of any and all official fees <br />and commissions of whatever kind or character, and from what- <br />ever source derived; the expenses of his office, including the <br />compensation of deputies and employees, shall be likewise paid <br />out of the treasury of the city. <br /> <br />Section 7-7. Appointment and term of judge, associate judges, <br /> substitute judges. <br /> <br /> The judge, associate judges and substitute judges <br />of the municipal court shall be appointed for four-year terms <br />by the judges of the courts of record of and for the City of <br />Portsmouth. Appointments to vacancies shall be for the unexpired <br />~erm. The terms of all associate judges and substitute judges <br />shall be coterminous with the term of the judge of said court. <br /> <br />Section 7-11o Powers and duties of substitute judge. <br /> <br /> In the event of the inability of the judge of the <br />municipal court to perform the duties of his office by reason of <br />sickness, absence, vacation, interest in the claim, proceeding <br />or parties before his court, or otherwise, the substitute judge <br />of the municipal court appointed as provided in section 7-7, <br />shall perform the duties of his office during such absence or <br />disability. He shall receive for his services a per diem com- <br />pensation at the rate received by the judge of the municipal <br />court° The council shall determine whether such compensation <br />shall be deducted from the salary of the judge of the municipal <br />court. An attorney appo~inted as substitute judge may continue <br />to practice law. <br /> <br /> <br />
