AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1961, BY REPEALING SECTIONS 7-2, 7-8, 7-10, 7-20, 7-21 AND 7-28 <br />THEREOF AND BY AMENDING SECTIONS 7-3, 7-4, 7-5, 7-5.1, 7-7, 7-11, <br />7-18, 7-22, 7-30 AND 7-40 THEREOF PERTAINING TO THE ADMINISTP~TION <br />OF MUNICIPAL COURT AND J~ENILE AND DOMESTIC RELATIONS COURT, AP- <br />POINTMENT OF A SPECIAL JUSTICE, AND APPOINTMENT AND REGULATION <br />OF JUSTICES OF THE PEACE. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by repealing Sections 7-2, 7-8, 7-10, 7-20, 7-21 <br />and 7-28 thereof. <br /> <br /> 2. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended and reordained to read as follows: <br /> <br />Article II - Court System <br /> Division 1. Generally <br /> <br />Section 7-3. Establishment. <br /> <br /> Pursuant to the provisions of the Charter of the City, <br />there shall be a Municipal Court for the City which may consist of <br />police, traffic and civil divisions, as designated by the Judge <br />of said Municipal Court. <br /> <br /> Pursuant to the Charter of the City there shall also <br />be a Juvenile and Domestic Relations Court for the City. <br /> <br />Section 7-4. Jurisdiction, practice and procedure. <br /> <br /> The jurisdiction, practice and procedure of such Courts <br />shall be in accordance with the applicable provisions of Title <br />16.1 of the Code of Virginia, 1950, as amended, and such other <br />general laws as may be applicable. <br /> <br />Section 7-5. High Constable; duties. <br /> <br /> The city council shall appoint an officer to be known <br />as the high constable, who shall serve at the pleasure of the <br />council and who shall have such powers and duties in relation to <br />the municipal court of the city as are now or may hereafter be <br />granted by the general laws of this Con~aonwealth to sheriffs, and <br />such other powers and duties as the council by ordinance may pre- <br />scribe. He shall qualify before the court of hustings of the city <br />and give bond in an amount to be determined by the council by <br />ordinance, payable to the city of Portsmouth, and conditioned <br /> <br /> <br />
