(I) Street Width. The shortest distance between the lines which delineate the right of way of a street. (m) Subdivision. The division of a parcel of land into two or more lots or parcels for the purpose, whether immediate or future, of transfer of ownership or of building development, including all changes in existing street or lot lines and any new streets; provided, however, that divisions of land into parcels of ~three acres or mor. e not involving any new street ~or easement shall not be deemed a subdivision; and further, pro- vided that any subdivision to which the City of Portsmouth or the Commonwealth of Virginia is a party shall not be deemed a sub- division. (n) Subdivision, Minor. The division of a parcel of land into not more than three (3) lots fronting on.an existing street and not involving any new street or the extension, mod- ifica~ion or widening of an~ existing street, street facilities, or utilities. Section 32-3. Preparation andrecordation of subdivision plats. (a) Any owner or proprietor of any tract of land, which is located within the City of Portsmouth, who subdivides such tract, or who causes any streets, alleys, or public areas to be created, shall cause a plat to be made of such subdivision and streets, alleys and public areas, and shall also cause such plat to be recorded in the office of the Clerk of the Court of HUstings for the City of~Portsmouth. Such plat shall be prepared in accordance with the requirements of this chapter. (b) The Clerk of the aforesaid court shall not file or record any such plat or any copy thereof required by this chapter to be recorded until such pla~ or copy thereof shall have been approved, and such approval evidenced thereon, in accordance with the provisions of this chapter. Cc) No building permitshall be issued for the erection of any structure or building to be located inany subdivision within the city; a plat whereof is required to be recorded pur- suant to the provisions of this chapter until such plat shall have been admitted to record as herein provided. (d) Every such plat shall be prepared by a land surveyor, duly licensed by the Commonwealth of Virginia, who shall endorse upon each such plat a_certificate signed by him setting forth the sources of the title of the owners of the land Subdivided, the place of record and deed-book reference of the last instru- ments in the chain of title, and the outlines of the several tracts shall be indicated upon such plat. -3-
