(d) A fin~ing by the City Manager that the applicant <br />consistently and habitually fails t~ cooperate with law enforce- <br />ment personnel in the exercise of their official duties. <br /> <br /> (el A finding by the City Manager that the applica- <br />tion is not properly completed as required by the ordinance. <br /> <br /> (f) A finding by the City Manager that the proposed <br />center fails to comply with the provisions of this ordinance. <br /> <br /> No other matters shall be sufficientgrounds f~r de- <br />nial of an application for such permit. <br /> <br />S~ction 19-95, Same, Revocation of permit. <br /> <br /> The City Manager may revoke or suspend the permit for <br />the operation of a commercial table top recreation center if he <br />finds: <br /> <br /> (1) That-the premises have been declared a com- <br />mon nuisance by a court of competent jurisdiction. <br /> <br /> (2} That clrcums=ances exist which would have <br />justified a denial of said permit at the time of its issuance. <br /> <br /> [~) That the permittee has consistently failed <br />in some material respect to operate the center on an orderly <br />basis in accordance with approved house rules. <br /> <br /> (4) That ~he permittee has failed to take prompt <br />and ¥igorous action against violations of crim%nal statutes oc- <br />curring on his premises, and known to %he permi~{ee. <br /> <br /> A permittee shall be entitled to a hearing before the <br />City Manager before such permit is revoked. Notice shall be served by certi- <br />fied mail, return ~eceipt requested. The City Manager shall, <br />as part of such notice, provide the permittee with a written <br />statement of the grounds for revocation or suspension and ad- <br />vise hL~ of his right to a hearing~ The hearing shall be held <br />not less than ten (10) days, nor ~re~than twenty (20) days after <br />the giving of notice, but the permittee may waive the ten day <br />limitation. The permittee~mhalI have the right to be represent- <br />ed by counsel at such hearing and may present evidence in his <br />own behalf. <br /> <br />Section 19-96.
