shall provide quality reception of its Basic Service to each sub- scriber so that both sound and picture are produced free from visible and audible distortion and ghost images on standard tele- vision receivers in good repair. Section 5A-38. Signal reception standards at headend. The franchisee shall in the operation of its system equal or exceed headend signal reception standards as set forth in the franchise agreement. Section 5A-39. Subscriber viewing standards. The franchisee shall in the operation of its system equal or exceed such subscriber viewing standards as are set forth in the franchise agreement. Section 5A-40. Performance monitoring° The franchisee shall conduct such performance tests at such intervals as required in the franchise and furnish to the de- partment written reports thereef in order to demonstrate compliance with sections 5A-37, 5A-38 and 5A-39 above° The department itself may also condu~t any performance tests it may deem necessary during norm~t business hours° Section 5A-4t. Amendment of performance standards. The council may amend the franchise agreement so as to add~ delete or modify the various performance standards prescribed therein upon the request of the franchisee~ the department or on its own motion if it appears that such changes are technically and economically feasible and are appropriate within the current state of the art. Such changes shall not be made until the franchisee has been given adequate written notice and an opportunity to be heard thereon. Article IXo System Regulation. Division 1. General Section 5A-42.
