Section 5A-43. Books and records of the franchisee. (a) The franchisee shall maintain an office within the city and shall designate such office as the place where all notices, complaints, directions~ orders and requests may be served or delivered. The city shall be notified of the loca- tion of such office and any change thereof. (b) The franchisee shall keep at such office a com- plete and accurate set of books of accounts and records of its business and operations under and in connection with the fran- chise granted hereby. (c) The council or the department or their officially designated representatives shall have access to all books of ac- count and records of the franchisee for the purposes of ascertain- ing the correctness of any and all reports and they may examine the franchisee's officers and employees under oath mn respect thereto. Furthermore, access shall be given to such representa- tives, upon request, to all supplementary financial and engineer- ing records. (d) Any false entry mn said books of account or re- cords of the franchisee~ or false statement in the reports to the city or its officially designated representatives as to a mater- ial fact~ knowingly made by the franchisee~ shall constitute a violation of a material provision of this ordinance. Section 5A-44. Copies of reports to regulatory agencies to be submitted to the department. At the same time as the franchisee, its affiliates and/or subsidiaries have filed a report, petition, or co~-~unica- tion with any state or federal agency pertaining to any aspect of operations hereunder or the financial arrangements therefor, it shall file a copy of such report, petition or communication with the department. Section 5A-45. Reports. (a) Within six (6) months from the effective date of its franchise, the franchisee shall submit to the department a plan of the entire City indicating the date on which the franchisee expects the installation of the system to be completed and avail- able for service to subscribers in the various areas of the city.
