AN ORDINANCE CLOSING A PORTION OF WEST ROAD ADJACENT TO MARY- VIEW HOSPITAL (S-72-13). WHEREAS, Maryview Hospital has made application to vacate, close and discontinue the hereinafter described portion of West Road; and WHEREAS, by resolution of this Council, adopted June 12, 1973, viewers were appointed pursuant to Section 15.1-364 of the Code of Virginia (1950] as amended, to view the here- inafter portions Of the said street and to report in writing whether in their opinion, any, and if any, what inconvenience would result from discontinuing tbs below described street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that that portion of West Road hereinafter described, be closed and vacated as a public street. That portion of West Road which is described as follows, to-wit: BEGINNING at a point on the Eastern right of way line of West Road at the Northeastern corner of a portion of said West Road which has been previously closed by ordinance of the City Council as said road ad- joins Maryview Hospital; thence from said point of beginning running North 41°14'26" West 124.31 feet to a point on the West right of way line of said West Road; thence running Southerly along the arc of a curve to the right, said curve hav- ing a radius of 243.26 feet a distance of 82.94 feet to a point (said last bearing and distance call being on the Western right of way line of West Road); thence running South 82'06'37'' East 80 feet to the said point of beginning; and also closed was a portion of any cul de sac turn- around lying South or West of the first mention- ed bearing call hereinabove indicated. AND BE IT FURTHER ORDAINED that the whole of such portion described herein shall be subject to an easement retained in favor of the City of Portsmouth for the construction, maintenance and repair of such water mains, sanitary sewers and storm drain faci- lities as may be required from time to time.
