AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1961, BY AMENDING SECTION 18-26 THEREOF PERTAINING TO <br />AUTHORIZATION OF CERTAIN OFFICERS TO DIRECT TRAFFIC AND PRO- <br />CEDURES TO BE UTILIZED THEREIN; AND BY AMENDING SECTION 18-55 <br />THEREOF PERTAINING TO PRESUMPTIONS FROM ALCOHOL CONTENT OF BLOOD. <br /> <br /> WHEREAS, the City' of Portsmouth is authorized to en- <br />act as ordinances certain statutes from the Code of Virginia, <br />provided such ordinances are.substantially consistent with <br />the state law; and <br /> <br /> WHEREAS, the General Assembly of Virginia at its 1973 <br />session amended certain of those statutes of the Code of Vir- <br />ginia, 1950; and <br /> <br /> WHEREAS, it is therefore necessary to amend certain <br />sections of the Code of the City of Portsmouth, Virginia, 1961, <br />so as to make said sections conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1973 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1961, be amended by amending Section 18-26, and Section 18-55, <br />such amended sections to read as follows: <br /> <br />Section 18-26. Officers and special deputies may direct <br /> traffic; signals. <br /> <br /> Peace or police officers may direct traffic by signals. <br />The chief of police may deputize persons over the age of eight- <br />een years without the power of arrest for the limited purpose <br />of directing traffic in accordance with ~ 46.1-183, Code of <br />Virginia (1950), during periods of heavy traffic or congestion, <br />provided, that such persons first receive training as the chief <br />of police determines necessary to fully acquaint such persons <br />with the techniques of traffic control. Any person who is depu- <br />tized as hereinabove provided shall at all times while engaged <br />in traffic control wear a distinctive police uniform, safety <br />vest or a white reflectorized belt which crosses both the chest <br />and back above the waist. Such signals other than by voice shall <br />be as follows: <br /> <br /> (a) To stop traffic by hand: Stand with shoulders <br />parallel to moving traffic. Raise arms forty-five degrees above <br />shoulder with hand extended, palm towards moving traffic to be <br />stopped. <br /> <br /> <br />
