have taken place since the member's death or retirement~ which- <br />ever first occurred. Such additional allowance shall be determined <br />as ~ percentage of the retirement allowance that would have been <br />payable iD the absence of this section and shall'be subject to the <br />same conditions of payment as are applicable to such retirement <br />allowancer with such percentage being computed as the percentage <br />increase in said Consumer Price Index from its monthly average for <br />the calendar year in which~the member's death or resirement occurred <br />to its monthly average for the calendar year immediately prior to <br />the calendar year as of which the amount of the additional allow- <br />ance is being determined. Any additional allowance provided under <br />this section shall be determined on a fiscal year basis only, as <br />of each July !~ and no such additional allowance shall be paid <br />to any person prior to the July t next following the expiration of <br />a period of twelve months after the end of the calendar year in <br />which took place the member's death or retirement, whichever first <br />occurred. In no case skal! the opcration of this section result in <br />a reduction in the amount of any person's total benefit belcw the <br />amount of the retirement allowance that would have been payable in <br />the absence of this section. <br /> <br />Section 26-~3. Ordinary death benefits. <br /> <br /> Should a me~er die in se~ice from a cause that is <br />~etermined not compensable under the Virginia Workmen's Compensation <br />Act, death benefits shall be payable as follows: <br /> <br /> (a) If the member at date of death has more than one <br />year of creditable service, there shall be paid in a l~p s~u/~, <br />in addition to any other benefit provided for in this artic!e~ an <br />additional benefit equal to one thousand dollars i-n accordance <br />with-section 26-87. <br /> <br /> (b) If the member at date of death has more than five years <br />of creditable service but has neither attained his fifty-fifth birth- <br />day nor completed twenty-five years of creditable service and is <br />survived by a ~idow, there shall be paid to such widow during her <br />widowhood an annual allowance, payable monthly, equal to one thousand <br />two hundred dollars a year, such allowance to be in addition to any <br />benefits provided for in subsection (a) above. <br /> <br /> (c) if the member at date of death has either attained <br />his fifty-fifth birthda~ or completed twenty-five years of credit- <br />able service, there shall be paid a retirement allowanc~ to the first <br />of the following listed persons, if any~ wh~ is alive at the death <br />of the member: Wife, husband~ mother~ fath~r~ sister or brother~ <br />provided such sister or brother received more than fifty percent <br /> <br /> <br />
