Section 26-81. Service connected disability retirement allowance. (a) Upon retirement as provided in section 26-80, a member shall receive an annual retirement allowance~ payable month- ly to him during his lifetime and continued disability~ in an amount equal to the tarter of: (i) ?wo-thirds of the me~er's average f~nat compensation; or (ii) Tke allowance to which the member would be entitled under ~he provisions of section 26-79 if his disability were not compensable under the Virginia Workmen~s Compensation Act. (b) The foregoing provisions to the contrary notwith- standing, if a member's retirement allowance is payable under one of the options of section 26-86~ the amount and duration thereof shai1 be determined in accordance with the provisions of the ap- piicaDte option~ (c) The compensation finally awarded to the member under the Virginia Workmen~s Compensation Act shall be deducted from any allowance becoming payable under the provisions of this section, and the excess of the at!owance~ if any~ shall be paid to the member. ~'~%en the time for payments of compensation under such act has elapsed, the member shall thereafter receive the full ~.ount of such allowance payable monthly d~mring his lifetime and continued disability. Section 26-82. Refund of accm~u!ated contributions. (a) Upon the retirement of a member or upon his termi- nation of service as an emptoyee~ other than by death, he shall be paid, on demand, but not later than ninety days thereafter, the amount of his accumulated contributions, if any, in a ltu?~o sum; provided that if the amount of such accmmulated contributions is less than ten doilars, no such payment shall be made. (b) Should a member die at any time while in servlce: the amount of his accumulated contributions shall be paid in a l~mp sum in accordance with section 26-87~ provided that if the amount of such accumulated contributions is less than ten dollars, no such payment shall be made. Section 26-82.1o Additional allowance. Any person receiving a retirement allowance under section 26-77, 26-79~ 26-81, 26-83(c) or 26-86 shall receive an additional allowance to reflect any adjustments in the United States Average Cons~mmer Price index for ail items~ as published by ~he Bureau of Labor Statistics of the United States Department of Labor~ that may
