In any case, ~nere <br />~he adequacy of flood prcofing measures shall be in issue, the <br />Building Official shall determine the matter. A person aggrieved <br />by a ruling of the Building Ozf~zal may appeal such ruling to <br />the Board of A~qusm~en~s and Appeals in accoraance wztn the pro- <br />vzsmons of Section ±1~ ~nrougn ~ of the Building Code of the <br />Czty- of Portsmouth. The Building Official and =h~.~e Board shall <br />m~ke their decisions in accordance w_tn the rules, regulations <br />and guidelines promulgated by the Federal Insurance Administrator. <br />If no guidelines shall have been provided by the A~ministrator, ~he <br />rules and regulations promulgated by the Office of the Chief of <br />Engineers~ U~ S. Army, shall be applied. <br /> <br />Sec%ion 40.1-6. <br /> <br />Building permits zn flood hazard districts <br />required; subdivision proposals in flood <br />hazard districts; contents of application; <br />standards for evaluation thereof. <br /> <br /> (a) Building permits shall be obtained from the Building <br />Official prior to the commencement of construction of new structures <br />or a~y substantial alteration to an existing structure in Flood <br />Hazard District 1. Building permits shall be reviewed to determine <br />whether the proposed construction (I) is protected against flood <br />damage; (2) is designe~ (or modified) and anchored to preve~nt <br />flotation~ collapse or lateral movement of the structure; (3) <br />uses construction materials and utility equipment that are resistant <br />to flood damage; and (4) uses construction methods and practices that <br />will minimize flood damage. <br /> <br /> (b) Building permits shall also be obtained from~ the <br />Building Official for major repairs to structures within Flood <br />Hazard District 1. The application for such permit shall be re- <br />viewed to determine that the proposed repair ~!) uses constrnc%ion <br />materials and utility equipment that are resistant to flood damage; <br />and (2) uses construction methods and practices that wilt minimize <br />flood damage. <br /> <br /> (c) Ail proposed subdivisions or group housing projects <br />reviewed in the office of the Building Official to assure that (i) <br />all such proposals are consistent with ~ne need to minimize flood <br />~a~ge; (2) all public utilities and facilities~ such as sewer, <br />gas~ electrica!, and wamer systems are located~ elevated and con- <br />smructed to minimize or eliminate flood damage; and (3) adequate <br />drainage is provided so as to reduce exposure to flood hazards. <br /> <br />-4- <br /> <br /> <br />
