The Building Official shall furnish a written report of his find- <br />ings to the Planning Coramission at such time as the subdivision <br />plat or group housing pro]ect site plan comes before the Planning <br />Cor~ission for preliminary approval or for a recom=mendation for <br />action, as the case may be. The Building Official shall review <br />plats and site plans prior to final approval by designated author- <br />ities, and he shall communicate his findings to the appropriate <br />authorities in writing. Disapproval of flood control measures <br />by the Building Official at any stage of review~ shall be grounds <br />for deferral or disapproval of the development by the Planning <br />Commission, City Council~ Director of Planning or City Engineer. <br />Any person whose plans or permzt application is disapproved on <br />grounds of inadequate flood protection measures shall be so in- <br />formed by the Building Cfficialo Such person shall then have the <br />right to have such decision reviewed by the ~oard of Adjustments <br />and Appeals by requesting such review in writing within five days <br />of receiving notice of disapproval. Whe Board shall review the <br />decision of the Building Official. and render its deciszon at its <br />earliest opportunity. If the original decision shall be reversed <br />by the Board, the plat~ site plan or building permit application <br />shall then be deemed approved insofar as flood control measures <br />are concerned. <br /> <br /> (d) Ail construction or substantial improvements made <br />to residential structures within Flood Hazard District 1 shall be <br />constructed with the lowest floor (including the basement) elevated <br />to or above the level of the one hundred year flood, i.e. 8.5 feet <br />above mean sea level. All new construction or substantial improve- <br />~ents made to nonresidential structures within Flood Kazard District <br />1 shall have the lowest floor Iinctuding the basement) elevated <br />to or above the level of the one hundred year flood, or together <br />with attendant utility and sanitary facilities, to be flood-proofed <br />up to the level of the one hundred year flood. The Building Official <br />shall determine the adequacy of flood-proofing measures, subject to <br />the guidelines stated elsewhere in this chapter. <br /> <br />Section 40.1-7. Non-conforming uses. <br /> <br /> Any non-conforming use legally existing at the time of <br />the adoption of this ordinance may be continued subject to the <br />rules contained in Section 40-32 through 40-39 of ~n_.s Code. <br /> <br />Section 40.1-8. Variance for places of historical significance. <br /> <br /> Where the literal enforcement of the requirements of <br />this chapter would apply to structures classified as having his- <br />torical significance by local, state or national historical <br />authorities, the Building Officiat~ at the request of the owner <br />of such structure or his duly authorized agent, may vary the <br />application of any provision of this chapter.
