(a) Application f~r a Certificate of Appropriatness <br />to externally repair, maintain, paint, locate, construct, re- <br />construct, alter, or demolish a building, structure, or any <br />other improvement in the Historic District shall be made to <br />the Secretary of the Commission of Architectural Review or <br />his ~esignee in writing by the owner of such building, struct- <br />ure or property. The application for such Certificate of <br />Appropriateness shall be accompanied by plans and specifications <br />of the part or parts of the building, structure, or other <br />improvement which are or will be subject to public view from <br />a public street, public way or public place. Such plans <br />and specifications shall show the proposed exterior architect- <br />ur~l features of such building, structure, or improvement <br />which shall include, but shall not necessarily be limited to <br />the general design, arrangement, texture, ma'terials, planting <br />and color, proposed to be used in the external repair, main- <br />tenance, painting, location, construction, reconstruction or <br />alteration of the building, structure o~ improvement and the <br />type of windows, exterior doors, lights, landscaping, parking <br />signs and other exterior fixtures and appurtenances ?h~ch will <br />be subject to public view from a public way or other public <br />place. <br /> <br /> (~) Nothing in this chapter shall be construed to <br />prevent the owner of such building, structure or property in <br />the historic district from performing any maintenance, alter- <br />ation or painting to the external architectural features of <br />such building, structure or'property which does not involve <br />a change in design, material, color or the outward appearance <br />thereof and which maintenance, painting or alteration is of <br />such nature that it may be lawfully affected without a permit <br />from the Building Official, provisions of Chis Article to the <br />contrary notwithstanding, nor to prevent any repair, maintenance, <br />painting or alteration of any such feature which the Building <br />Inspector shall certify to be required by the public safety <br />because of an unsafe or dangerous condition. <br /> <br />Section 40-99. <br /> <br />Approval or disapproval of plans and speci- <br /> fications; issuance of Certificate of Appropriate- <br /> ness; issuance of permit. <br /> <br /> Upon receipt of an application for a Certificate of <br />Appropriateness required by Section 40-96 and the plans and <br />specifications, .the Co~mission shall confer with the applicant <br />for the Certificate of Appropriateness, and shall approve or <br />disapprove such plans and specifications, andif approved shall <br />issue.a Certificate of Appropriateness therefor with or without <br /> <br />-5- <br /> <br /> <br />
