commission. The co~ission in the exercise of its powers and <br />performance of its duties shall act only by formal resolution <br />which shall set forth the reason for its decision and the vote <br />of'each member participating therein which shall be spread <br />upon its records which shall be open to public inspection. Ev- <br />ery such decision of the commission shall be based upon a <br />finding of fact which shall be reduced to %~iting an~ preserved <br />among its records. The commission shall submit an annual <br />report of its activities to the City Council. <br /> <br /> (g) Upon request of the commission, and with the <br />approval of the City Manager, the departments, bureaus, <br />divisions, boards, commissions, offices and agencies of the <br />city government shall furnish to the commission such available <br />information and render it such service as may be required for <br />the exercise of the powers and performance of the duties of <br />the commission. <br /> <br />Section 40-96. Permit required; prerequisites to issuance. <br /> <br /> No improvement, except as noted in Section 40-101, <br />in the Historic District shall be externally repaired, maintained, <br />painted, located, constructed, reconstructed, altered, or <br />demolished unless a Certificate of Appropriateness is issued by <br />the Commission of Architectural Review. No reauired building <br />permit shall be issued by the Building Official unless: <br /> <br /> (a) A Certificate of Appropriateness has been issued <br />for the purpose of the Commission to the owner thereof; and <br /> <br /> (b) The external repair, maintenance, painting, <br />location, construction, reconstruction, alteration or demolition <br />thereof otherwise complies with the requirements of the Building <br />Code and other ordinances and laws applicable and relating <br />thereto; except as otherwise provided in Section 40-102. <br /> <br />Section 40-97. "Owner" construed. <br /> <br /> The owner of any such building, structure, or property <br />for the purpose of this article shall include any person or <br />governmental agency, having the legal or equitable right to <br />repair, maintainv paint, locate, construct, reconstruct, alter, <br />or demolish such building, structure or other improvements. <br /> <br />Section 40-98.
