No such permit shall be granted to any person except <br />upon a certification by the Chief of Police that such person <br />has appeared at police headquarters and had been photographed, <br />had his fingerprints taken, and presented a certificate signed <br />by five persons that such person is of good character and honest <br />demeanor; and except and until the Chief of Police has been <br />satisfied from the information furnished and/or from an independ- <br />ent investigation made by the Division of Police that the state- <br />ments contained in the application and certificate required <br />hereinabove are true; and except and upon payment of a permit <br />fee in the amount of Two Hundred and 00/100 ($200.00) Dollars <br />per annum, such permit fee shall not be proratabte or transferable. <br /> <br />Section 3-44. Revocation of permit. <br /> <br /> Upon the violation of any of the provisions of this <br />Article or upon a showing that the applicant is not a person <br />of good character and honest demeanor, the City Manager shall <br />have the right to revoke the permit after due hearing; said <br />hearing being held not less than five days after notice in <br />writing to the holder of the permit. Su=h notice shall be sent <br />by registered mail to the address given by the holder of the <br />permit when applying for such permit. Nothing contained herein <br />shall preclude any other remedy allowed by law. <br /> <br />Section 3-45. Penalty. <br /> <br /> Any person who shall tell fortunes, act as a clairvoyant, <br />or practice palmistry, phrenology or handwriting analysis within <br />the City without first obtaining the permit provided for in Section <br />3-41 herein, shall be guilty of a misdemeanor; provided~ however, <br />that nothing contained in this Articte shall be construed to apply <br />to persons who tell fortunes, act as a clairvoyant or practice <br />palmistry, phrenology or handwriting analysis as part of any <br />carnival, circus or trained animal show as provided for in Section <br />20-74 of this Code. <br /> <br />Section 3-46.
