AN ORDINANCE TO AMEND TILE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA (1973) BY ADDING TO CF~APTER 37 THEREOF A NEW ARTICLE <br />(ARTICLE IV) PERTAINING TO REGULATION OF THE TOW TRUCK BUSINESS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth that the Cods of the City of Portsmouth, Virginia (1973), <br />be amended by adding to Chapter 37 thereof a new article (Article' <br />IV), such new article to read as follows: <br /> <br />ARTICLE IV. TOW TRUCKS <br /> <br />Section 37-180. Tow trucks called to accident scene; <br /> assistance of police officers on scene. <br /> <br /> Whenever it shall be necessary to procure a tow truck <br />to render services at the scene of any traffic accident or traffic <br />hazard, any police officer present shall assist the operator or <br />owner of a distressed motor vehicle in obtaining tow truck services. <br />Police communications facilities may be used as necessary to con- <br />tact tow~operators. If the owner or operator concerned requests <br />that a specific tow truck service be called, such request shall <br />be honored unless the officer in charge determines, in his dis- <br />cretion, that the tow operator requested is located at too great <br />a distance or is o~herwise actually unavailable to furnish the <br />required services in a timely manner. <br /> <br />Sectioh 37-181. Tow book to be maintained by city manager. <br /> <br /> (a) The city manager shall maintain a register of <br />tow operators who shall be called in sequence to provide services <br />at the scene of accidents or traffic hazards. The tow book shall <br />be utilized only in those cases where the owner or operator of a <br />distressed motor vehicle does not, for any reason, provide the <br />police officer in charge with the name of a tow operator avail- <br />able to perform the required service in a timely manner. <br /> <br /> (b) The tow book may be maintained and administered <br />by the city manager, or he may delegate such authority to the <br />chief of police. The term city manager shall always include the <br />chief of police when used in this section unless the context re- <br />quires otherwise. The city manager may prescribe conditions for <br />tow operators who apply to be included in the tow book, and he <br />may also establish rules and regulations which must be obeyed by <br />tow operators who are listed in the tow book.
