AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973 BYAM-ENDING SECTION 23-235 THEREOF PERTAINING TO THE RELEASE <br />OF IMPOUNDED AUTOMOBILES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1973, be ~mended by amending Section 23-235, such amended section <br />to read as follows: <br /> <br />Section 23-235. Release from impoundment upon payment <br /> of charges and costs. <br /> <br /> No motor vehicle, trailer or semitrailer impounded under <br />the provisions of this division shall be released or removed from <br />the city pound except upon payment by the owner thereof, or his <br />duly authorized representative, to the chief of police, who shall <br />lssue a receipt therefor, of a towing charge of twenty-five dol- <br />lars ($25.00) plus a storage charge, if the motor vehicle, trailer <br />or semitrailer has been impounded for a period longer than twenty- <br />four hours, of two dollars per day or fraction thereof, plus cost <br />of publication of any notice required by any of the provisions of <br />this Code, plus cost of investigation as to ownership and liens <br />required by any of the provisions of this division; provided, <br />that the city manager may release any such impounded motor ve- <br />hicle, trailer or semitrailer from the city pound without the <br />payment of such charges and costs, or any part thereof, whenever <br />he deems it proper so to do. Such owner, or his duly authorized <br />representative, upon delivery of the motor vehicle, trailer or <br />semitrailer to him, shall sign a receipt for the same. The pay- <br />ment of costs herein set forth, or the release of any impounded <br />motor vehicle, trailer or semitrailer, without the payment of <br />any or all of such costs, shall not operate to relieve the of- <br />fender from the liability of any fine or penalty for the viola- <br />tion of any law or ordinance on account of whiuh the motor ve- <br />hicle, trailer or semitrailer was impounded. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held February 25, 1975. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
