AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />'1973, BY A~iENDING AND REORDAINING SECTIONS 31-30(a)(I), 31-30(b) <br />31-39, 31-41, 31-55, 3!-62(c), 31-63[a) (2), AND 31-63(c), AND 31- <br />63(e)~ 31-65Ia) (1) (2) (3), 3!-65(b), 31-70(b)~ 31-77(c), 31-79, <br />31-118(a) (1), 3i-118(b), 31-129, 31-148(c), 31-149(b) r 3!-155(b) <br />AND 31-162 lc) OF SAID CODE PERTAINING TO THE PORTSMOUTH SUPPL~...~4ENTAL <br />RETIRF~MENT SYSTEM AND THE FIRE AND POLICE RETIRE~LENT SYSTEM. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth~ <br />Virginia: <br /> <br /> 1. That Section 31-30(a) (1) and (b) and 31-118 Ia) (i) <br />and (b) be amended and reordained to read as follows: <br /> <br /> (a) (!) Upon his termination of service as an employee, <br />other than by retirement, before he has completed five (5) years <br />of creditable service; provided, howeverr that for purposes of <br />this section, the entrance of a member into authorized leave of <br />absence shall not constitute terr~ination of service as an employee; <br />provided the member reenters service as an employee at the ex- <br />piration of the period of authorized leave~ and that the entrance <br />of a me~ber into the Armed Forces of the United States shall not <br />constitute termination of service as an employee~ provided the <br />member's service in such Armed Forces qualifies as creditable <br />service under Section 31-126; or <br /> <br /> (b) Should any person terminate service as an employee, <br />other than by retirement under the provisions of this Article, <br />after he has completed (5) five years of creditable servlce; and <br />should such person at any time again become an employee, any <br />benefits becoming payable under the provisions of this Article <br />shall be determined on the basis of the total creditable years <br />of service combined for all such periods of employment. <br /> <br /> 2o That Section 31-39 be amended and reordained to <br />read as follows: <br /> <br /> Any person who was formerly a m~mber of the system <br />and who ceased to be a m~ber upon becoming a member of the Vir- <br />ginia Supplemental Retirement System may, upon again becoming <br />an employee, be restored to membership in the system and. have <br />his previous time as a member counted as creditable service <br />provided (1) he has remained in continuous service with the <br />city and a combined city-state office and (2) verification of <br />previous time as a member can be sho%zn subject to the approval <br />of the Board° Creditable service for a period of membership <br />in the Virginia Supplemental Retirement System is subject to <br />the provisions of Sec° 31-41. <br /> <br /> <br />
