AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AMENDING SECTION lt-12THEREOF, PERTAINING TO PURCHASES <br />AND REQUISITIONS; CONTRACTS INVOLVING CITY FUNDS; WAGES IN PUBLIC <br />WORK OR IMPROVEMENT CONTRACTS EXCEEDING $~0,000. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That Section 11-12 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to read <br />as follows: ' <br /> <br />Section 11-12. <br /> <br />Purchases and requisitions; contracts involving <br />City funds; wages in public work or improvement <br />exceeding $50,000. <br /> <br /> (a) The City Purchasing Agent shall, under the super- <br /> vision of the Director of Finance, purchase all supplies for the <br /> City, and sell all personal property declared as useless, except <br />· the purchase of such supplies and the sale of such personal pro- <br /> perty for which Council may make other provisions. <br /> <br /> Before making any purchase or sale, the City Purchasing <br />Agent shall give opportunity for competition under such rules and <br />regulations promulgated by the Director of Finance. Such rules <br />shall provide for the right of the City Manager to reject any and <br />all bids and parts of a bid. All advertisements of such bids <br />shall contain a reservation of the right of rejection. No pur- <br />chases shall be made unless the Director of Finance certifies <br />that funds are available. <br /> <br /> (b) ~ny public work or improvement costing more than <br /> One Thousand ($1,O00.) Dollars shall be awarded to the lowes~ re- <br /> sponsible bidder after public advertisement and competition. The <br /> City Manager shall reserve the right to reject any and all bids <br /> and all advertisements shall contain such reservation. <br /> <br /> (o) (1) Any person entering into any contractual agree- <br />ment with the City for any type of public work construction or im- <br />provement funded from the Capital Improvement Fund costing more <br />than'Fifty Thousand ($50,000.) Dollars shall pay not less than the <br />prevailing wage rates for all types and classifications of such <br />work ~s established by the United States <br />the T~dewater area.
