to ascertain from the Federal Department of Labor prevailing <br />wage rates in the Tidewater area for workmen in the class of <br />work called for in such construction projects. The prevailing <br />wage rates shall be posted on each job site by the contractor. <br /> <br /> (3) Any person who may contract to do public work <br />construction or improvement funded from the Capital Improvement <br />Fund with the City over Fifty Thousand ($50,000.) Dollars shall, <br />upon request, furnish the City Manager certified copies of <br />payroll records including employees names, hours worked and <br />rates paid; and shall maintain and preserve such payroll records <br />for inspection by the City M~nager until ninety (90) days after <br />comple~ion of such construction. <br /> <br /> (4) Any person who may violate any provisions of <br />this section shall be punishable by a fine of not more than <br />Fifty ($50.00) Dollars for each such offense. Each day that <br />an employee is not paid in accordance with provisions of this <br />section shall constitute a separate offense. <br /> <br /> (5) City of Portsmouth, having only adopted the <br />prevailing wage determinations herein set ou~, shall in no <br />w~se be sub3ect to any .provisions of the Davis-Bacon Act <br />(40 U.S.C. 276(a). <br /> <br /> 2.
