AN ORDINANCE TO AMEND T~E CODE OF THE CITY OF PORTSMOUTH, VIRGINIA~ <br />1973, BY AMENDING SECTION 38-43 OF SAID CODE PERTAINING TO FEES <br />TO BE CHARGED WHEN WATER SERVICE HAS BEEN TURNED OFF AND BY AMEND- <br />ING SECTIONS 38-77 and 38-79 OF SAID CODE PERTAINING TO FEES FOR <br />SEWER AND SEWAGE DISPOSAL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1~ That Section 38-43 of the Code of the City of Ports- <br />mouth, Virginia, 1973, be amended and reordained to read as follows: <br /> <br />Section 38-43. <br /> <br />Who may turn water back on; fee for turning on <br />upon termination of service for nonpayment~ in- <br />spection fee when water is turned on by un- <br />authorized person. <br /> <br /> When water service to premises has been shut off by the <br />department of public utilities, no one except a representative of <br />the department of public utilities may turn the water on again. <br />When the water service to a premises has been shut off at the meter <br />cutoff valve for nonpayment, the amount due and a fee of seven <br />dollars and fifty cents ($7.50) for turning on shall be paid before <br />the water service will be restored; provided that, in the event <br />water service to premises has been turned on by an unauthorized <br />person, there shall be an inspection fee of seven dollars and fifty <br />cents ($7.50) to cover the cost of the requisite inspection~ Such <br />fees shall not apply to shutting off water service at the tap <br />cutoff valve, but the provisions of section 38-48[d) shall govern. <br />When a water customer applies for initial water service or moves <br />from one residence to another, there shall be a fee of seven <br />dollars and fifty cents ($7°50) charged for establishing the <br />new account and turning on water at ~he new residence. <br /> <br /> 2. That Section 38-77 of the Code of the City of Ports- <br />mouth, 1973, be amended and reordained to read as follows: <br /> <br />Section 38-77. Charges for service establishedD <br /> <br /> Any person contracting with the city for sewage disposal <br />service, or the owner, leasee or tenant, or any or all of them, <br />who uses or occupies any real estate which directly or indirectly <br />is or has been connected, with the sewage system of the city, or <br />from or on which originates or has originated sewage or industrial <br />wastes or other wastes which directly or indirectly enter or will <br />enter the sewage system shall pay to the city for the use and <br />services of such system the fees, rents and charges according to <br />the following schedule of rates: <br /> <br /> <br />
