thirty (30) days from the date on which the application was <br />received, for approval or disapproval; and the report shall <br />be forwarded to the Building Official. <br /> <br />Section 40-114. Approval of application. <br /> <br /> In the event'the commission recommends approval <br />the application to remove an offical marker or to demolish or <br />alter a building as provided for in Section 40-113, the <br />Building Official shall mmmediately so advise the o%~mer. <br /> <br />of <br /> <br />SectiQn 40-115. Procedure upon denial of application. <br /> <br /> In the event the recommendation of the Co~-unission <br />ms to deny the application to remove an official marker or <br />to demolish or alter a building as provided for in Section <br />40-113, it shall at the same time recommend whether or not <br />the building should be acquired, leased or otherwise dealt <br />with in accordance with law. The Building Official shall <br />forward immediately such report to the City Manager for <br />transmittal to the Council at its next regular meeting to- <br />gether with any comments which he may deem appropriate. At <br />the same time, the Building Official shall notify the owner <br />of such action and the owner shall not remove the official <br />marker, nor demolish, nor alter the structural exterior appear- <br />ance of the building until the expiration of six (6) months <br />from the da~e on which the owners application was received <br />by the Commission of Architectural Review unless authorized <br />by the Council. The Building Official shall not issue a <br />permit.to demolish or alter any such building until the <br />expiration of six (6) months from the date on which a copy <br />of such application-was received by the Commission of Archi- <br />tectural Review unless authorized by Council. <br /> <br />Section 40-116. Unauthorized removal or demolition of building. <br /> <br /> It shall~be unlawful for any person, whether as <br />owner, contractor or otherwise, who knows or has reason to <br />believe that a bu%tding is a historic building as set forth <br />in this ar{icle, ~o cause or participate ~n the removal of <br />an.official marker or in the demolition or alteration of a <br />building in violation of the provisions of this article. <br /> <br />Section 40-117. <br /> <br />Acceptance and disposition of gifts, devises, <br />etc., toward preservation of historic buildings. <br /> <br />Ail persons interested in the preservation of historic <br /> <br />-18- <br /> <br /> <br />
